Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
School and Child Care Center Classes: Kinderdance and Fitness Hill Country holds most of our classes in partner school and child care facilities. These locations each have procedures and health screenings in place to minimize the risk of spreading contagious diseases. KFHC will follow all health and safety guidelines of our partner school to teach students already in attendance.
Community Center Classes: KFHC will implement standard health screening before allowing any student to participate in a community center location.
1. I understand that I as a parent will NOT be permitted to enter the facility beyond the designated drop-off and pick-up area. I understand that this procedure change is for the safety of all persons present in the facility and to limit to the extent possible everyone’s risk of exposure.
2. I understand that IF there is an emergency requiring me to enter the facility beyond the designated drop-off and pick-up area I MUST sanitize my hands before entering, remove my shoes, and wear a mask. While in the facility I must practice social distancing and remain 6ft from all other people, except for my own child.
3. I understand that to enter the facility premises my child must be free from COVID-19 symptoms. If, during the class, any of the following symptoms appear my child will be separated from the rest of the people in the facility. I will be contacted, and my child MUST be picked up from the studio within 15 minutes.
Symptoms include:
â— Fever of 100.4 degrees Fahrenheit or higher
â— Dry cough
â— Shortness of Breath
â— Chills
â— Loss of taste or smell
â— Sore Throat
â— Muscle aches
Additionally, KFHC has put in place preventative measures to reduce the spread of COVID-19; however, KFHC cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending KFHC could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending KFHC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at KFHC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, KFHC employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at KFHC or participation in KFHC classes. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless KFHC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of KFHC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any KFHC program, class or event.
