Liability Waiver for Personal Injury or Damage/Business Liability Waiver/Use of Photographic Likeness

1.Liability Waiver for Personal Injury or Property Damage

As part of the consideration to Hillsboro Dance Center, LLC, for providing dance instruction, the undersigned student/parent does hereby release and discharge Hillsboro Dance Center LLC, it's agents, employees, and/or representatives from any and all liability and damage which the student may sustain from personal injury and/or property damage that may occur as a result of the student's participation in dance instruction. This release includes the actions of Hillsboro Dance Center LLC, its owners, agents, employees and/or representatives as well as the actions of other students.

Student/Parent understands that by enrolling, the student will learn dance techniques and methods which have been developed by Hillsboro Dance Center, LLC. Student/Parent understands that this instruction requires students to engage in physical activity. Student/Parent represents and warrants to Hillsboro Dance Center, LLC that the student is in good physical condition, has consulted with student's physician or has had the opportunity to consult with student's physician, and is able to participate in said activities.

If the student has a physical disability or limitation which may affect the student's ability to participate, student/parent will notify Hillsboro Dance Center, LLC, not less than seven days prior to their first class. Hillsboro Dance Center, LLC will make every effort to accommodate student's limitations. Hillsboro Dance Center, LLC, reserves the right to require an additional release to be signed by student/parent and student's physician.

2. Business Liability Waiver
Hillsboro Dance Center LLC and/or its principals, employees, or other representatives will teach specific dance methods and techniques. Student/Parent agrees, represents, and warrants that students will learn the techniques learned in a reasonable manner. Student/Parent further warrants that the student will use his/her best judgment and discretion in the application of the teachings learned. Student/Parent warrants and represents that they waive any claims, causes, or complaints which occurs or arises from student's use of the learned techniques.

Student/Parent further understands that this waiver applies to both physical, property, business, or financial damages which may arise. Student/Parent agrees to indemnify and defend Hillsboro Dance Center, LLC or its owners, agents, employees, and/or representatives from any cause or claim brought by a third party arising out of use of the dancing techniques or methods learned.

The waivers of liability in this agreement apply to both the student as well as their parent or legal guardian.

3. Use of Photographic Likeness
By signing below you authorize Hillsboro Dance Center, LLC to use photographs taken of you/minor student, for advertising, blogging, and educational purposes. Moreover, you relinquish all right title and interest of photographs, negatives, reproductions, digital copies/media, and copies of originals to Hillsboro Dance Center, LLC. By relinquishing your rights, Hillsboro Dance Center LLC, has the right to give, sell, transfer and exhibit the prints, copies, facsimiles, or digital copies thereof for social media, education and advertising purposes, and to transform, assign or sell such images to any responsible individual, business, firm or publication or to any of their assignees.

COVID-19 LIABILITY AND INDEMNIFICATION WAIVER

Hillsboro Dance Center, LLC (HDC) has implemented numerous health and safety measures to reduce the risk of exposure to COVID-19. However, COVID-19 is an extremely contagious disease that poses numerous health risks, including death, especially to elderly people and those with underlying health risks.

I understand that my, or my child’s participation and/or attendance at HDC, will increase my, or my child’s risk of contracting COVID-19.

HDC employees may have multiple jobs that increase their potential exposure to COVID-19. These additional jobs include but are not limited to jobs in retail, sales, and service. Although additional safety precautions will be taken by these employees, I understand that my or my child’s involvement with said employees may further increase the likelihood of contracting COVID-19.

By signing this document you agree that:

You are solely responsible for your own safety. You will follow all posted instructions, policies and guidelines, while attending and/or participating in HDC programs and events.

You release, discharge, waive, indemnify, and hold HDC, its members, officers, agents, employees, independent contractors, affiliates, successors, and assigns (Released Party) harmless from all liability, claims, and/or demands, arising from COVID-19, whether it is directly or indirectly related to your loss, damage, injury, or death.

This waiver extends to claims of negligence or the Released Party, or any third party participating or attending HDC.

You release, discharge, waive, indemnify, and hold the Released Party harmless from all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising directly or indirectly from any claim made by or against any of the Released Parties as a result of injury, death, loss of use, monetary damager from you attendance/participation at HDC, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.

You agree that this COVID-19 Waiver of Liability and Indemnification in no way limits or terminates any previously or contemporaneously executed HDC General Waiver of Liability, but rather will serve as an addendum to the HDC General Waiver of Liability.

HDC will strive to continue conduction in-person instruction however, it may be necessary and/or required for HDC to temporarily discontinue this form of instruction. In the event that HDC is forced to shut down, they will move their in-person instruction to Zoom or an online video conference equivalent.

You acknowledge that you have read the foregoing Waiver of Liability and Indemnification understand it and are signing it voluntarily. There have been no oral representations, statements, or inducements other than what is contained in this written agreement. You are at least eighteen (18) years old or are the parent or legal guardian of the minor under eighteen (18) years old, and are fully competent.

It is understood by the parties that appropriate instruction involves demonstration, physical dance posture molding, and other physical touching activities. This release includes the actions of Hillsboro Dance Center, LLC, its owners, agents, employees and/or representatives as well as the actions of other students.

Student/Parent understands that by enrolling, the student will learn dance techniques and methods which have been developed by Hillsboro Dance Center, LLC. Student/Parent understands that this instruction requires student to engage in vigorous physical activity including jumping, tumbling, aerials, and group stunts. Student/Parent represents and warrants to Hillsboro Dance Center, LLC, that the student is in good physical condition, has consulted with student’s physician or has had the opportunity to consult with student’s physician, and is able to participate in said activities.

If the student has a physical disability or limitation which may affect the student’s ability to participate, Student/Parent will notify Hillsboro Dance Center, LLC, not less than seven (7) days prior to their first class. Hillsboro Dance Center, LLC, will make every effort to accommodate student’s limitations. Hillsboro Dance Center, LLC, reserves the right to require an additional release to be signed by Student/Parent and student’s physician.
