I acknowledge that this activity involves exertion and carries with it the potential for injury. I hereby agree to waive the right to take legal action against Clann Lir Academy, Inc., employees, owners, associates, and/or affiliates, contractors, volunteers, or otherwise, for injuries incurred in conjunction with any Clann Lir Academy, Inc. activity or events. It is understood and agreed that the participant, i.e. ‘Dancer’, is physically fit and prepared for participation in the activities which will be undertaken, and that the participant has not been advised by any doctor or other medical person that participation in these activities, or similar, should be avoided and/or limited.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Clann Lir Academy Inc (“Clann Lir”) has put in place preventative measures to reduce the spread of COVID-19; however, Clann Lir cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Clann Lir could increase your risk and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Clann Lir and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Clann Lir may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Clann Lir employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Clann Lir or participation in Clann Lir programming. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Clann Lir, its employees, agents, owner, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Clann Lir, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Clann Lir program.

I understand that my students picture may appear on Clann Lir Academy's ("Clann Lir") social media accounts (Facebook, Instagram, Twitter, etc.) and website to promote Clann Lir and student / team achievements. By enrolling in classes with Clann Lir I provide consent for my students picture to be used on Clann Lir's social media accounts, on Clann Lir's website, and in online or print advertisements. It I do not want my students picture to be used for these purposes, I will notify Clann Lir at parentsportal@clannliracademy.com.

If, and when, online classes or tutorials, whether pre-recorded, live streamed or mobile app based, (i.e. 'online tutorials'), are offered by Clann Lir Academy, you acknowledge and understand that participation by your child is at your sole liability. You agree to monitor and/or observe your child's participation when they are viewing or partaking in online tutorials. Further, you agree that your child will use appropriate footwear and flooring when partaking in online tutorials. Please note that online tutorials may be recorded for record-keeping, quality assurance and training purposes.

Full tuition and registration fees are due when first registering for class. All payments are final, non-refundable. I understand that Clann Lir Academy requires auto-pay enabled (e.g. Bank/ACH, credit card) on my account in order to enroll in classes. I understand that if I do not wish to have auto-pay enabled, I must first enable auto-pay on the Parents Portal when registering and then send an email to parentsportal@clannliracademy.com in order to have auto-pay disabled. Further, I understand that this does not waive my liability for making timely tuition payments on or before the beginning of each Trimester my student is enrolled in classes. I understand that if tuition payments are not made on time, I will be charged a late payment fee, as outlined below, and the applicable fee will be posted to my account balance. Further, I understand that if my student stops taking classes, or enrolls and never attends, and I fail to give notice that my student should be unenrolled from Clann Lir Academy, I may still be charged tuition via auto-pay until such notice in writing is received by Clann Lir Academy.

TUITION PAYMENTS
At least 7 days prior to the beginning of each trimester Clann Lir Academy will notify all active/email subscribed account owners and post tuition due to each students account. You will be able to then log into your account to update bank and credit card information used for auto-pay or make a one-time payment via ACH or credit card toward the account balance. All credit card payments are subject to a 3% convenience fee. Payment via auto-pay (ACH) incur no additional fees. Manual payments (check, cash) are accepted and will be logged against your account balance in the Parents Portal.

ACCOUNT BALANCES
Prior to the beginning of each trimester, you must make full payment toward your account balance in order to take classes for the upcoming trimester. Your account balance may include fees for: late payments, drop-in classes, extra classes, workshops, etc. that have been posted to your account between trimester payments.
