I am the Parent/Legal Guardian of this student.
I fully understand and acknowledge that,
(a) risks and dangers exist while participating in physical activities such as dancing
(b) the participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury.
I agree to release, waive, discharge, and hold harmless Burlington Dance Academy Inc., it's owners, and it's employees from any liability, claims, actions or losses for bodily injury, property damage, or otherwise which may arise out of The Minor's participation in services provided by Burlington Dance Academy Inc. I also authorize Burlington Dance Academy Inc. to take all reasonable steps to respond to medical emergencies and to seek medical treatment in the case of an injury.
ASSUMPTION OF RISK & RELEASE OF LIABILITY RELATING TO CORONAVIRUS/COVID-19
This waiver form must be accepted with an acknowledgement before any use of the facilities is made. Individuals who are sick or who have been in contact with someone who is suspected of having COVID-19 must not use the facilities or attend dance classes. This access may be withdrawn at any time based on health agency recommendations and government guidelines.
I am the parent/legal guardian of this student who would like to participate in dance education classes at Burlington Dance Academy Inc. In response to efforts to contain the spread of COVID-19 coronavirus, I am aware that I am using the facilities at my own risk and will ensure that I will conduct myself in a way that is appropriate. I confirm that I do not have any symptoms of COVID-19 including but not limited to fever, sore throat, coughing, aches, respiratory problems, dry cough, fatigue, diarrhea, loss of taste or smell, chest pain, rash on skin, discolouration of fingers or toes, headache.
. I agree to complete a daily COVID-19 coronavirus self-assessment BEFORE arriving at Burlington Dance Academy Inc.
. I agree to stay home if I feel unwell
. I have a plan to be picked up promptly if I develop any symptoms.
. I will seek a COVID-19 test when exhibiting symptoms, or, in the absence of a test, self-isolate prior to returning to school
. I agree to comply with the orders provided by Public Health.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. Burlington Dance Academy Inc. has put in place preventative measures to reduce the spread of COVID-19; however, Burlington Dance Academy Inc. cannot guarantee that you or your child(ren) will not become infected with COVID-19. Attending any public spaces increases your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Burlington Dance Academy Inc. and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Burlington Dance Academy Inc. may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Burlington Dance Academy Inc. employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Burlington Dance Academy Inc. or participation in programs at Burlington Dance Academy Inc. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Burlington Dance Academy Inc., its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Burlington Dance Academy Inc., its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Burlington Dance Academy Inc. program.
FORCE MAJEURE
In the event Burlington Dance Academy Inc. and its parties is unable to perform its obligations under the terms of this Agreement because of acts of God, wars, pandemics (including but not limited to COVID-19) or other causes reasonably beyond its control, such party shall not be liable for damages to the other for any damages resulting from such failure to perform or otherwise from such causes.
FEES AND PAYMENTS
I agree to provide payment as outlined in the Fee Schedule by (1) auto-payment via a valid credit card on file in the online portal, OR (2) via valid post-dated cheques provided at the time of registration for the full year, OR (3) complete payment at the time of registration. If the above is NOT provided, NSF charges will be posted to my account accordingly and interest will be charged at the rate indicated on my statements. If payment is not made on a timely basis, my student will be refused entry into class. I agree to provide one month's notice/one month's payment if my student wishes to withdraw. If my student wishes to withdraw AFTER January 31, 2025, payment is due in full and I agree to pay the balance of lesson fees for the remainder of the year on the withdrawal date. Lesson fees are the ONLY fees charged to customers accounts via auto-pay. The convenience fee is waived by Burlington Dance Academy for lesson fees ONLY. Any fees, besides lessons, must be paid by the client and are not auto-processed by Burlington Dance Academy unless expressed solely by the client.
YEAR-END RECITAL
Year-End Recital costume fee charges are automatically added to your account when you register. If you WISH that your child/children participate in the 2024-2025 year-end recital at the Burlington Performing Arts Centre (BPAC), you agree to pay the applicable recital costume deposit BEFORE December 1, 2024 and will be advised if there are any additional fees over & above the initial deposit.

Burlington Dance Academy MUST RECEIVE WRITTEN NOTICE (via e-mail) if you DO NOT WISH TO PARTICIPATE in the 2024-2025 Year-End Recital. (Recital charges will be removed from your account at that time.)
I have read, understand, and agree to the above terms of participation and the assumption of risk of participation and release all liability.
