WAIVER AND RELEASE OF LIABILITY

In consideration of the risk of injury while participating in a Texas Galaxy Cheer & Dance Program, and as consideration for the right to participate. I hereby, for myself, my heirs, executors, administrators, assigns, or personal rights, claims or causes of action of any kind whatsoever arising out of my participation in the activity mentioned above, and do hereby release and forever discharge Texas Galaxy Cheer & Dance, located Texas Galaxy Cheer & Dance, and their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I am voluntarily participating in the aforementioned Activity and I am participating in the Activity entirely at my own risk. I am aware of the risks associated with traveling to and from as well as participating the Activity, which may permanently disability (including paralysis), economic loss, and death. I understand that these injuries or outcomes may arise from my own or other negligence, conditions related to travel, or the condition of the Activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in thus Activity, including travel to, from, and during this Activity.
I agree to indemnify and hold harmless Texas Galaxy Cheer & Dance against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf.
I acknowledge that Texas Galaxy Cheer & Dance and their directors, officers, volunteers, representatives, and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Texas Galaxy Cheer & Dance.
I acknowledge that this Activity may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors, and/or producers of the event.
I acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I expressly agree to release and discharge Texas Galaxy Cheer & Dance and all of its affiliates, managers, member, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, from any ND all claims or causes of action and I agree to voluntarily give up or waive any right that otherwise have to bring a legal action against Texas Galaxy Cheer & Dance for personal injury or property damage.
To the extent that statue or case law does not prohibit releases for negligence, this release is also for negligence on the part of Texas Galaxy Cheer & Dance, its agents and employees.
In the event that I should require medical care to treatment. I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
In the event that any damage to equipment facility occurs as a result of my family’s willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or between two parties of equal bargaining strength.
Both the participant and Texas Galaxy Cheer & Dance agree that this agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered. Into.
I the event that at provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase, or portion of the agreement shall be determined to be unlawful or otherwise not affect the intent of the parties. If a court should find that any provision of this agreement to be invalid or enforceable, but that by limiting said provision it would become valid and enforce, then said provision shall be deemed to be written, constructed and enforced as so limited.

I also give Texas Galaxy Cheer and Dance permission to take photos of my child to use on social media, flyers, and other advertising platforms.

I, the undersigned participant, affirm that I am of the age of 18 years or older, and that I am freely, acknowledging this agreement. I certify that I have read this agreement, that I fully understand its content and that this release cannot be modified orally. I am aware that this is a release of liability and a contract and that I am accepting these terms on my own free will.

I hereby certify that I give my consent without reservation to the foregoing on behalf of this individual.

I hereby certify that I am the parent/ guardian, of the registered student, and do hereby give my consent without reservation to the foregoing on behalf of this individual.

Texas Galaxy DOES NOT offer refunds. Charges may be deleted off the students account to leave credit on their account to be used at any time for monthly tuition, merchandise, private lessons fees, competition fees, or costume/uniform fees. If there is an extreme circumstance (I.E. Death/Medical leave) and we approve the credit, we must subtract the 5% in credit card processing fees before refunding. Credit is only offered to services not offered. If the student only attended 1 day of the month, text /e-mail us and we will change the monthly charge to reflect $15 for each class attended. (1 class = $15, 2 classes= $30, 3 classes= $45)

Tuition is posted on your child account the 1st of every month.

Late fees are $10 every 7 days. Late Fees are posted at 9PM every 7th, 14th, 21st & 28th of every month.

Will ONLY delete the last 30 day of late fees ONLY once account is paid down to 0!

If the account is not paid on in over a month, the student must sit out/ observe class. The class where a student sits, is not excused from payments or any attendance requirements. The $10 late fee will still continue to add to the debt, until a payment plan is made and the payments are being made.

Competition students have an obligation to their team for the full season. If you are unable to finish the season or child is removed from the team for any reason, you're subject to pay the $250 cancelation fee. If the team changes divisions or charges a "last minute" change fee, and you're the reason for the change, you are responsible for those charges as well. The $10 weekly late fee will be added until a resolution is made. All past due payments are subject to be sent to collections or taken to civil court.

It is not our intent to punish a child for a parental responsibility, and we are not here to take your money for no reason, but too many accounts are not being paid for, and the rules are meant to help keep people on track with their bills, and to keep us in business.
