Parents, legal guardians, and students indemnify and agree to holds harmless Taylor Dance Program Inc (TDP), its Board of Directors, officers, instructors, agents, and assigns from any and all liability whatsoever, for any damage or injuries, and from any and all claims and demands, including attorney fees, arising out of the party’s participation in dance lessons, classes, workshops, performances, fundraisers and other related activities provided by TDP. Parents, legal guardians, and students recognize and acknowledge that certain risks of harm are or may be inherent in the various activities contemplated herein and that TDP cannot control all of these risks. By registering a student with TDP, parents, legal guardians, and students acknowledge they are aware that dance training and tumbling exercises associated with dance training place unusual stress on the body and carry with them the risk of physical injury. Parents, legal guardians, and students assume the risks involved and also understand that dance instruction involves kinetic correction that may include physically touching the student as part of the regular class work and/or rehearsal. Parents, legal guardians, and students understand and agree that TDP faculty have permission to engage in appropriate kinetic correction of the body for technical corrective purposes as part of regular class work and rehearsal. In addition, parents understand the risks and hazards of the novel coronavirus (“COVID-19”) and readily acknowledge and willingly choose to participate in activities with TDP. Furthermore, parents acknowledge and fully assume the risk of infection, illness or death of themselves, a family member, or student related to COVID-19 arising from being on the premises and participating in the activities associated with TDP and indemnify, defend and hold harmless Taylor Dance Program Inc (TDP), its Board of Directors, officers, instructors, agents, and assigns and the City of Taylor from and against any and all claims, demands, suits, judgments, losses or expenses of any nature whatsoever (including, without limitation, attorneys’ fees, costs and disbursements, whether of in-house or outside counsel and whether or not an action is brought, on appeal or otherwise), arising from or out of, or relating to, directly or indirectly, the infection of COVID-19 or any other illness or injury. Additionally, Parents, legal guardians, and students understand that students may appear in promotional performance videos, photographs, brochures, and other materials as a result of their association with TDP. By registering a student for class, such use of the student’s name and likeness are agreed to and acknowledged and, accordingly, all right, title and interest in same are waived.
