LIABILITY WAIVER AND BUSINESS POLICIES

LIABILITY WAIVER
By registering to attend any Kellehers Dance Academy (“KDA”) classes you agree to the Release of Liability Agreement:

1. I certify the participant is in good health and proper physical condition to participate in Kellehers Dance Academy (KDA) Classes. I acknowledge it is my responsibility to consult with a physician for medical clearance for the participant prior to participation in KDA Classes (e.g. due to any injury or medical condition, including pregnancy) and agree to advise KDA of any injury, physical limitations or if I am pregnant. I understand KDA reserves the right to refuse participation in KDA Classes.
2. I understand there are risks and hazards associated with KDA Classes and that despite reasonable precautions, accidents can occur. I certify the participant is voluntarily participating KDA Classes and accepts and assumes the risks of injury involved in participation in KDA Classes.
3. I expressly waive, release and discharge KDA, including its owners, employees, volunteers and other KDA participants, individually or otherwise, from any and all liability, to the extent permitted at law, in relation to any claim for damages for any personal injury (including death), property damage or loss, or action of any kind, which might arise out of or in connection with participation in KDA Classes, or before, during or after KDA Classes.
4. I have read this accident waiver and release of liability and understand its contents.
5. I have also been made aware of the KDA Code of Conduct and KDA Payment, Cancellation and Privacy Policies (either by provision of a hard copy or access to it on the KDA portal) and am aware that participation in KDA Classes is subject to them.


KDA CODE OF CONDUCT & KDA PAYMENT, CANCELLATION & PRIVACY POLICIES:

CODE OF CONDUCT
KDA is committed to providing safe, exciting and educational Classes for all of our students. We believe that ethics – moral principles, standard practices, and etiquette are important elements in the dance world and should be part of a dancer’s education. In order to provide a safe and uplifting environment for everyone, we ask that instructors and students follow the studio’s code of conduct. It takes everyone to create a positive learning experience. Thank you in advance for working together.

STUDENTS
1. Students are required to show respect to their instructors and other students.
2. Students are required to respect the studio property and premises.
3. Students should try to attend all classes, punctually and as a courtesy, apologise when interrupting a class and to advise teachers (in advance when possible) if they will be
absent from a class.
4. Students are required to revise and practice when preparing for a performance/s and enrol in the classes as agreed upon for the performance class.
5. Students are required to moderate their language, conversation and behaviour when they are representing the studio.
6. Students are required to clean up after themselves and maintain clean studios and amenities.
7. Students are required to be respectful when other classes are taking place.
8. Students are required to use deodorant at all times. Students who perspire excessively should keep a personal hand towel on hand and/or change of clothing.
9. Lost Property will be available at the studio for one month.
10. Students must report to the reception desk at the start of each class. This allows us to monitor attendance.

CANCELLATION POLICY
1. When using this website/parent portal, you are subject to the following Terms, Conditions and Policies. These can be updated from time to time. Make sure you read the Terms and Conditions before purchasing your classes.
2. Please note all transactions are listed in Australian Dollars (AUD).
3. KDA Fees are paid per term and are non-refundable. A student will not be able to re-enrol for future classes until all Fees are paid from the previous term.
4. Non-attendance – If you miss a class you can do a make-up class at your convenience (your level or an alternative) before the end of the term. Contact us if you are unsure which classes you are eligible to attend. Please note, if you fail to take a makeup class within a term we do not offer transfer of credit to the next term. If you can provide a Doctor’s Certificate, we will be happy to transfer your credit to the following term.
5. If you are injured/sick for 5 weeks or more and can provide a Doctors Certificate we will credit your Fees to the following term.

PAYMENT OF FEES POLICY
1. All Fees must be paid in full by 14 days after your Registration or Enrolment Fee has been paid. Please note exemption can be made to families who have 2 or more students attending KDA. We can split your Fees up.
2. Please note we have added a yearly Registration/Enrolment Fee of $20. Maximum amount paid per family is $60
3. Members must register for Classes via the website/parent portal every term. This allows us to know our female/male class ratio.
4. Enrolment allows you access to your enrolled Classes as specified by KDA.
5. Students will be compensated in the rare event that a Class is cancelled.
6. Breaching the code, depending on the severity of an incident will result in one warning and failure to follow instruction will be followed by a suspension.
7. Stealing is not tolerated and will result in immediate expulsion from the school. Whether direct acquisition of another person’s property, not paying studio fees or not enrolling in classes/paying the required fees of the course without prior agreement.

PRIVACY POLICY
The privacy of your personal information is very important to KDA. We will not sell, rent or trade your personal information to any third party. We will take special care to protect the privacy and security of your information. This policy explains our information practices and the way that KDA collects and uses your information. This Privacy Policy covers the information you provide to us offline and on KDA’s website.

HOW DOES KDA COLLECT AND USE MY INFORMATION?
When you register for Classes at KDA, we collect contact information such as guardian names, addresses, phone numbers, emergency contacts, e-mail address and student information such as student names, birthdays, medical conditions, and your comments. Some of the information is required and is noted with a red asterisk on the forms. This information is needed to manage studio business and will not be used or sold for any other purpose, except as described below. Some of the information is optional (NOT marked with a red asterisk). Optional information is requested to help us better understand our students/participants and is used only as needed for studio business. This information will not be used or sold for any other purposes, except as described below.

WHO HAS ACCESS TO MY INFORMATION?
When you register on our website, you are required to enter an e-mail address and a password. The combination of that e-mail account and password is used to ensure that only you have access to, and only you have the ability to modify, your personal information through Dance Studio Pro website. KDA’s office personnel have access to your personal information only to manage the studio business.

KDA will access your personal information and/or share it with third parties only for the following purposes: (i) as needed for studio business; (ii) if required to do so by law or to comply with legal process; or (iii) to protect the rights, property, or personal safety of the public. If you have any questions about our Privacy Policy or if you wish to update or remove any of your personal information, please contact the office.

Our websites will link to other websites and services from time to time. KDA will always attempt to associate with only the most trustworthy partners who share our high standards regarding privacy. Nevertheless, we are not responsible for the content of and privacy practices of any other companies or websites.
