WAIVER AND RELEASE FROM LIABILITY
FOR MINOR CHILD
READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS

ACCEPTANCE OF LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK. Please read this LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK (hereinafter, the “WAIVER”) carefully before enrolling or otherwise participating in dance classes and activities offered by Synergy Dance Center, LLC (the “Services”) Doing Business As Daje Dance Academy and Ardent Fitness. This WAIVER governs your initial registration and/or use of the Services as well as any future registration and/or use of the Services.

This WAIVER take effect when you click an Accept (or similar) button or checkbox presented with this WAIVER or at the time of registering and/or using the Services. By accepting this WAIVER, you represent that you have lawful capacity to enter into contracts, e.g., you are not a minor, and that you are freely and voluntarily agreeing to be bound by this WAIVER. If you are agreeing to this WAIVER on behalf of a student for whom you have legal responsibility, you represent that you have legal authority to act on the student's behalf, and you consent and agree to this WAIVER on your behalf and on behalf of the student.

I have chosen to enroll my Child to participate in dance, dance instruction, and or physical exercise activities provided by Synergy Dance Center, LLC, a Utah limited liability company, doing business as Studio 19 Dance Center.

I understand the nature of the activities my child will be participating in at Studio 19 and represent that my child is in the proper physical condition and capable of participating in the related activities, understanding that Studio 19 is not in any way responsible for making such a determination.

I recognize that there are certain inherent risks associated with dance, dance instruction, and/or physical exercise activities, and I assume full responsibility for any personal injury to my Child, and release and discharge Studio 19 from liability for any injury, loss, or damage arising out of my Childs participation in the activities provided by Studio 19 or the presence of myself, my Child, or any other of my family members upon the facilities of Studio 19, whether caused by the fault of myself, my family, Studio 19, or other parties.

In consideration of my Childs participation at Daje/Ardent, I agree to indemnify and defend Studio 19 against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my Childs participation in the activities provided by Studio 19, or the presence of myself, my Child, or any other of my family members upon the facilities of Studio 19.

I understand that Studio 19 is not responsible for my child or other persons under my supervision who are left unsupervised in the common areas and areas surrounding the Studio 19 facilities and acknowledge that Studio 19 will only be supervising my child when he or she is participating in scheduled dance activities, programs or instruction, or exercise activities.

I understand that Studio 19 is not responsible for personal property that is lost, damaged, or stolen while my Child or I are present at the Studio 19 facilities.

I acknowledge and agree that it is my responsibility to maintain my own accident and health insurance coverage for my Child and that Studio 19 does not provide accident or health insurance for those participating in its instruction, activities, or programs.
I authorize and agree that Studio 19 may take and use photographs, videos or likenesses of myself, or my child as needed for its record-keeping, advertising and/or public relations projects and that I have no rights to the same and will not be compensated for the same.

I agree to pay for all damages to the Studio 19 facilities caused by any negligent, reckless, or willful actions of my Child or myself.

If any provision of this Agreement is determined to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force.

If any ambiguity or question of intent or interpretation arises, no presumption or burden of proof favoring or disfavoring any party by virtue of the authorship of any of the provisions of this document is to be utilized.

The laws of Utah govern all matters relating to this Agreement, including torts.

I agree to attempt to resolve any dispute arising out of or relating to this document through friendly negotiations. If the matter is not resolved by friendly negotiations, I agree to submit to mediation of the matter prior to seeking any other right or remedy afforded to me or my Child by applicable law.

I agree and acknowledge that I have been given a reasonable opportunity to review this document before signing it.

I AFFIRMATIVELY STATE, REPRESENT, AND WARRANT THAT I HAVE READ THIS DOCUMENT AND UNDERSTAND IT AND THAT BY CLICKING ACCEPT, I AM VOLUNTARILY SURRENDERING CERTAIN LEGAL RIGHTS.
