LIABILITY WAIVER
As a participant or the parent/guardian of a participant of The Dance Company of Ocala, LLC, I recognize and acknowledge that there are certain risks of physical injury and I agree to assume full risk of any injuries, including damages, death or loss which may be sustained as a result of participation in any activities connected with The Dance Company of Ocala, LLC. I agree to waive and relinquish all claims against The Dance Company of Ocala, LLC and its faculty members from any and all claims resulting in the participation in the program. In case of accidents or sickness, I consent to emergency medical care for my child/myself to be provided by ambulance or hospital personnel. I acknowledge the contagious nature of COVID-19 and other contagious diseases and viruses and voluntarily assume the risk and I and/or any children may be exposed to or infected by COVID-19 by attending and participating and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 and other contagious diseases and viruses may result from actions, omissions, or negligence of myself and others, including, but not limited to, employees, volunteers, and program participants and their families.
PHOTOGRAPHY AND VIDEOGRAPHY RELEASE WAIVER
I, parent/legal guardian, hereby grant permission to The Dance Company of Ocala, LLC to the absolute and irrevocable right and unrestricted permission to use, display, distribute, transmit, publish, republish, copy or either in whole or part either digitally, in print or any other medium now or hereafter known, for any purpose take and use photography and videography of myself or those mentioned above for which I am responsible for the legal guardian of, or in which I may be included: to alter the same without restriction and to copyright the same. I understand and agree that The Dance Company {of Ocala} may or may not use my name in conjunction with the photographs. I hereby release and discharge representatives, assignees, and staff from any and all claim and demands arising out of or in connection of publicity and defamation. This release shall be binding upon my heirs, legal representatives, my assigns and me. This agreement embodies the entire agreement of the parties dancer, photographer, videographer, and The Dance Company of Ocala, LLC.
Permission is granted for these photographs and videos to be used for any lawful advertising material past, present, or future including but not limited to The Dance Company {of Ocala}'s website and Facebook page even if my child is no longer a student under contract with The Dance Company of Ocala, LLC.
TDC COMMUNICABLE DISEASE RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT
In consideration of being allowed to participate in any way in any The Dance Company of Ocala, LLC (“TDC”) related events and activities I, the undersigned participant, parent, or legal guardian, acknowledge, appreciate, and agree that:
By participating in TDC related events and activities, there are certain risks to me arising from or related to possible exposure to communicable diseases including, but not limited to, the virus “severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)”, which is responsible for the Coronavirus Disease (also known as COVID-19) and/or any mutation or variation thereof (collectively referred to as “Communicable Diseases”). I am fully aware of the hazards associated with such Communicable Diseases and knowingly and voluntarily assume full responsibility for any and all risk of personal injury or other loss that I may sustain in connection with such Communicable Diseases.
I, for myself or for my minor child(ren) or ward(s), and on behalf of my/our heirs, assigns, beneficiaries, executors, administrators, personal representatives, and next of kin, HEREBY EXPRESSLY RELEASE, HOLD HARMLESS, AND FOREVER DISCHARGE THE DANCE COMPANY OF OCALA, LLC and its officers, officials, agents, representatives, employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises upon which TDC related events and activities take place (the “Released Parties”), from any and all claims, demands, suits, causes of action, losses, and liability of any kind whatsoever, whether in law or equity, arising out of or related to any ILLNESS, INJURY, DISABILITY, DEATH, OR OTHER DAMAGES incurred due to or in connection with any Communicable Diseases, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by law.
I agree that this Agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Florida, and if any portion hereof is held invalid, it is agreed that the remainder shall continue in full legal force and effect.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
TUITION
For those on the monthly tuition package, tuition is due by the 1st of every month. A late fee of $10.00 will be added to payments made after the 7th. An additional $5.00 will incur each additional week until balance is paid. There will be a $30.00 charge for any returned check. Payments may be made online with credit and/or debit or at the studio with credit, cash, and check. Tuition and registration fees are Non-Refundable and Non-Transferable.
I have reviewed and understand the additional fees associated with having a dancer at TDC. I understand the costuming price ranges, the family recital fee for each recital ($30.00) and the general admission ticket information which includes parents.
STUDENT SECURITY
To ensure the safety of TDC students, we require all faculty, students, and parents to follow these security procedures. Since visibility to the parking lot is limited and the lobby is often busy, there is no way to verify that dancers reach the appropriate persons. Therefore, dancers under the age of fifteen may not leave the premises unless escorted by parent/guardian-approved persons. Dancers must wear cover-ups when entering and exiting the premises. This promotes modesty as well as professionalism.
