Liability/Video & Picture Waivers and Acknowledgment of Risk

I understand and agree that in participating in any dance class, workshop, birthday party, rehearsal or performance, there is a possibility of physical injury. I am fully aware of the risks, illnesses and hazards connected with receiving cosmetic services, costume apparel and consuming provided food during the birthday party celebrations. I voluntarily agree, therefore, to assume all risks and responsibility for any such injury, accident, risk, illnesses and hazards, which might occur to me or my child during any of Lela Belles Studio of Dance classes, rehearsals, performances, birthday parties or activities.
I also exempt, release, and indemnify The Lela Belles Studio of Dance, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, and/or students from any and all liability claims, demands, or causes of action whatsoever from any damage, loss, illnesses, injury, or death to me, my children, or property which may arise out of or in connection with participation in any classes or activities conducted by Lela Belles Studio of Dance.
Dance Photography/Video Release Waiver
I hereby authorize Lela Belles Studio of Dance to publish photographs taken throughout the duration of the class sessions of myself and/or the minor child or children listed below, and our names and likenesses, for use in the Lela Belles Studio of Dance's print, online and video-based marketing materials, as well as other Company publications.
I hereby release and hold harmless Lela Belles Studio of Dance from any reasonable expectation of privacy or confidentiality for myself and for the minor child and children listed below associated with the images specified above. Further, I attest that I am the parent or legal guardian of the child or children listed below and that I have full authority to consent and authorize Lela Belles Studio of Dance to use their likenesses and names.
I further acknowledge that participation is voluntary and that neither I, the minor child, nor minor children will receive financial compensation of any type associated with the taking or publication of these photographs or participation in company marketing materials or other Company publications. I acknowledge and agree that publication of said photos confers no rights of ownership or royalties whatsoever.
I further hereby voluntarily agree to waive my rights and that of my heirs and assigns to hold Lela Belles Studio of Dance, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, and/or students liable for such damage, loss, injury, or death. I understand that I should be aware of my physical limitations and agree not to exceed them. If I am signing this waiver for my children, I certify that I am the parent or legal guardian and have the right to waive these rights.
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Lela Belle Studio of Dance has put in place preventative measures to reduce the spread of COVID-19; however, Lela Belles Studio of Dance cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending Lela Belles Studio of Dance could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Lela Belles Studio of Dance and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Lela Belles Studio of Dance may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Lela Belles Studio of Dance or participation in classes, workshops or events. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Lela Belles Studio of Dance, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Lela Belles Studio of Dance, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Lela Belles Studio of Dance program, class, workshop or event.
UNDERSTANDING OF RISK
I understand the seriousness of the risks involved in participating in this program, my personal responsibilities for adhering to rules and regulation, and accept them as a participant.
