Arnprior School of Dance Assumption of Risk and Waiver of Liability
AS THE PARENT OR GUARDIAN OF A PARTICIPANT, YOU MUST READ THIS WAIVER AND CLICK THE BUTTON TO INDICATE YOUR ACCEPTANCE.
In consideration of being allowed to participate in any way in the Arnprior School of Dance classes (activities), I, and/or the minor Participant, and/or the Participant for which I am the legal guardian, the undersigned:
ELEMENTS OF RISK
1. Understands that the Activities, like all recreational activities, involve risk of serious injury, including permanent disability or death, and severe social and economic losses which might result from participant action, inaction, negligence of others, rules of play, or the condition of the premises or any equipment used thereon.
2. Understands that there may be other risks not known or reasonably foreseeable at this time and that such risks shall be assumed by the undersigned.
3. Understands that the chance of an injury occurring can be reduced by carefully following instructions at all times while engaged in the Activities.
ACKNOWLEDGEMENT
4. Understands that as a Participant in the Activities, I am assuming the risks associated with the Activities.
ACKNOWLEDGEMENT FOR PARENTS/ LEGAL GUARDIANS
5. Fully understands that the Activities for which I have given permission to the Participant to be involved in may involve personal risk, dangers, and hazards which all participants are required to assume including but not limited to some risk of personal injury caused by physical activity or other participants. Understanding this, I hereby accept on behalf of the Participant all risks, dangers, and hazards as well as the possibility of personal injury or other loss resulting from the Participant’s participation in the Activities. Parents &/or family members are not in the teaching rooms during class time, we have viewing days during the session when family is invited in to watch. Parents are to be present when classes end to ensure the safe transition of your child from the studio to your vehicle.
INDEMNIFICATION
6. Agrees to indemnify and save harmless the Arnprior School of Dance, its employees, officials, agents, directors, and volunteers, from any and all liability for injury, death, property damage or any other loss sustained by the Participant as a result of participation in the Activities to any cause whatsoever; including negligence, breach of contract, or breach of any statutory or other duty of care; and
Agrees to indemnify and save harmless the landlord and the owners of 394 Russett Drive, Arnprior, for the same.
COVID-19
Individuals who are sick or who have been in contact with someone who is suspected of having Covid-19 must not use the facilities or attend classes. This access may be withdrawn at any time based on health agency recommendations. In response to efforts to contain the spread of COVID-19 Coronavirus, I am aware that I am using the facilities at my own risk. If at anytime I travel outside of Canada or have been in contact with anyone who is suspected of having COVID-19, I agree to have my family follow the current health department guidelines in place to reduce the spread of COVID-19; however, Arnprior School of Dance cannot guarantee that you or your child(ren) will not become infected with COVID-19. Attending any public spaces increases your risk and your child(ren)’s risk of contracting COVID-19.
REFUNDS
There are no refunds of birthday parties, you will be issued a credit to your account if a written notice is sent to asoddirector@gmail.com cc - brittanypaquette2017@gmail.com. If you choose to rebook your party, you will be responsible for the price difference if there is one. Partial refund for tuition if written notice is sent to asoddirector@gmail.com and cc brittanypaqueette2017@gmail.com before the start of the second class (minus $50.00 of tuition amount only). A 50% credit of tuition fees will be applied to your account for any written notices received after the second class up to the start of the fourth class (tuition amount only). No credits will be issued after that. ASD will not refund costume payments if students leave the program or do not participate in the recital.
CLASSES
Refunds or makeup classes will not be provided if ASD is not able to provide the full term of lessons when cancellations that were due to reasons outside of our control such as a staff shortage, power outages, pandemics, mandated shutdowns or weather related closures. Refunds or makeup classes will not be provide to students that miss classes due to family holidays or illness. Dancers who register for January to May classes will be part of the year end recital at Algonquin College in Ottawa.
PERMISSION
I, as the parent or guardian of the Participant, hereby confirm that this child is a minor pursuant to the Age of Majority and Accountability Act and provide permission for him/her to be a Participant in the Activities organized by the Arnprior School of Dance. I allow Arnprior School of Dance to use my child's image for advertising.
Arnprior School of Dance will not be held responsible for any Cyber: privacy breaches, hacking, technology malfunction or damage.
