We pride ourselves in offering the very best at the Kellie Jerman’s School of Performing Arts. We want nothing but to serve you and your dancer with a safe and inviting space. This is something we all deserve and is required of anyone that shares are very special space. Please read through entirely before signing.

Please arrive in advised hair and dance attire. Ballet requires a leotard, tights, ballet slippers, hair in a bun. All other genres may wear form fitting dance wear and required shoes. NO BAGGY CLOTHES
The dancer or his/her guardian must give us prior notice before an absence and it must be within a reasonable amount of time.
Warm up time is one of the most important times of class. Please arrive 5 minutes before class starts.
No chewing gum or food of any kind during class.
Guardians are welcome to watch the last 15 minutes of class, during the last class of the month. Feel free to record the last 15 minutes of class so your dancer has an up to date video of their routines to practice with.
If Competitive Dancers are injured, they are encouraged to attend class to observe. If under doctor’s orders to refrain from physical activity, we ask that dancers speak with us to discuss class options. If you have a fever or are throwing up, please stay home.
If a dancer is sick or injured and is unable to participate in class for three consecutive weeks, they may not be guaranteed a competitive position. Please contact Kellie Jerman ASAP so we can work through this situation effectively and in a positive direction.
All students are required to "Check In” when they arrive using the studio tablet. We use this software to track class/student attendance.
Competitive Dancers that have over three absences could be subject to requiring an extra TEAM rehearsal. When this happens it’s a $150.00 fee per hour, that will be your responsibility to pay for. (The reason I’m requiring a team rehearsal instead of a private to catch your dancer up, is they have spots they need to memorize along with being a part of stunts. A team rehearsal is the only way we can assure that your dancer is fully caught up)
Adversely, all who sign this document agree to the possibility of an unscheduled rehearsal if needed.
One month before a competition or performance, all dancers must attend all classes and rehearsals. If they are absent, they will not be allowed to compete or perform unless circumstances causing the absence were obviously unavoidable. It is very important to the team that all dancers are mentally and physically prepared. This applies at all times of the year. (Please be mindful when scheduling your family vacations during our Performance and Competition season)
Competitions and performances are mandatory. Dancers are required to attend all rehearsals and performances. Dancers will not be excused from performances or rehearsals for family or friend parties. If you are aware of possible conflicts, contact Kellie as soon as you know so we can discuss. Often times these conflicts can be avoided with proper planning. There is no way to reschedule a rehearsal or performance when a dancer gives little or minimal notice. The more notice we receive, the greater the possibility of avoiding a conflict.
If your rehearsal is longer than 2 hours, snacks or meals may be brought into the studio lounge. Water is the only beverage allowed.
Please pick up your dancers promptly at the end of class. If you will be late, please call or text Kellie Jerman. (For safety reasons dancers must wait inside the studio or under the awning for their ride. Dancers are not allowed to wait by the road and must stay within our line of sight.)
Ongoing (3 or more) late pickups will result in a $25.00 per half hour fee (starting at the 10 minute late mark). This fee will be charged automatically to your credit card on file with a convenience fee.
Dancers are not allowed to leave the premises without a parent or designated guardian. If someone other than the guardian will be picking up your dancer, the guardian must communicate to Kellie Jerman, the name of the individual who will be picking your dancer up.
Being a small studio, we cannot offer makeup classes because each class we offer is unique to the individual student or group.
The studio is under constant camera surveillance. Everything is recorded for the protection of both your dancer and our studio.
We are so fortunate to be able to work with some pretty exclusive and amazing equipment (reformer, chair, trampoline, bosu, fitness balls, bands, and so much more). We will be teaching our dancers how to respect this expensive equipment and how to properly maintain it. If the student disrespects or damages the equipment purposely, it will be the guardians responsibility to pay for any and all damages done.

We provide unique and extensive professional training. Any of Kellie Jerman’s Methods taught within the studio or online are the property of Kellie Jerman. They are exclusive to the studio and our online platforms. Any teaching of this material to students outside of our school will result in immediate expulsion. (If you’re interested in being trained in these methods, I offer training programs.)

Advancing Will be based on the following:

Audition
Work ethic during class and rehearsals
Attendance
Physical ability, flexibility, technical ability, performance ability, mental ability
Being a good example to others, leadership, teamwork, drive, motivation
Being able to handle constructive criticism
Discipline and ability to make corrections

Financial Concerns

Dancers missing class will not have their tuition pro-rated or refunded for any reason.
All fees posted to your portal must be paid on time and in full. Private and Semi Private lessons are due at the time of booking and are non-refundable.
Venmo, Cash, Checks, Debit Cards, Visa, Discover and MasterCard or direct deposit into our America First account are accepted in person or online. You must leave a credit card number on file to bill late charges, or pay monthly with a convenience fee.
School of Performing Arts members must keep a current credit card on file. If your tuition, fees or costume payments are 15 days past due we will automatically bill your credit card with a convenience fee plus an additional $25 late fee.
Any dancer with an account that is more than 30 days past due, will be unable to attend class. NO EXCEPTIONS
All registration fees, costume deposits, choreography fees, and tuition are non-refundable.
If a dancer will be dropping a class or leaving the team for any reason, you must give reasonable notice to Kellie IN WRITING, 30 days prior. If you decide to end your team commitment early, you will be responsible for all team fees, tuition, and account charges for the full year. Please remember you are making a yearlong commitment.









Standards

Dancers must respect all staff, teachers, parents, office managers, and other students.
Dancers must clean up their messes and keep their bags in a cubby. If you make a mess, please clean it up.
Dancers will not touch property of others. Stealing or borrowing without permission will not be tolerated.
Kellie Jerman's School of Performing Arts members are leaders in the dance community. Poor behavior at competition, in class, at school, or online will not be allowed at any time.

Competitions and Performances

Dancers need to arrive in the dressing area at the specified time. If a dancer is late, they may be unable to compete or perform. Arrival time is the time you are in the dressing room, ready to participate (Not arriving at the event.) Please plan for traffic, bad weather, parking, etc. Being on time is an important part of being on a team. Being on time is part of respecting others.
Dancers will have good sportsmanship, be polite, and support all other competitors at all times. Dancers will have a positive attitude no matter what the outcome of the competition. Competition is an opportunity to perform and improve. Winning is nice, learning is better!
Dancers are representing Kellie Jerman’s School of Performing Arts and will be on their best behavior at all times. Dancers will follow all rules and never make fun of or talk negatively about other teams or school members.
Guardians and spectators are not allowed backstage. Spectators must also follow all rules of the competition and have good sportsmanship, just as the dancers do.
Guardians must be in the dressing room helping their dancer prepare and change costumes. This is not the teacher’s full responsibility. Your dancer is not old enough to have this responsibility alone. Please plan ahead for someone to assist your dancer if you are unable to.









I have read and understand Kellie Jerman’s School of Performing Arts Policies, Procedures and Etiquette. If problems occur, the following steps will be implemented in a particular order. The order is as follows:

Dancers will first receive a verbal warning.
If verbal warning is unsuccessful, a parent/dancer meeting will be held.
If issues are not resolved during parent/dancer meeting, the dancer will be removed from the School.

By singing this document, I understand that we are making a commitment throughout the Dance Season we signed up for and agree to everything listed within this document.


Liability Waiver


In consideration of the risk of injury while participating in Kellie Jerman’s Classes/Instruction (the "Activity"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Kellie Jerman, located 5041 Viking Dr Ogden, Utah 84403, the Kellie Jerman School Of Performing Arts located at 749 40th Street South Ogden, Utah 84403, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH TRAVELING TO AND FROM AS WELL AS PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED TO TRAVEL, OR THE CONDITION OF THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN OR UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY, INCLUDING TRAVEL TO, FROM AND DURING THIS ACTIVITY.

I agree to indemnify and hold harmless Kellie Jerman against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Kellie Jerman incurs any of these types of expenses, I agree to reimburse Kellie Jerman.

I acknowledge that Kellie Jerman and their directors, officers, volunteers, representatives, heirs and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Kellie Jerman.

I ACKNOWLEDGE THAT THIS ACTIVITY MAY INVOLVE A TEST OF A PERSON'S
PHYSICAL AND MENTAL LIMITS AND MAY CARRY WITH IT THE POTENTIAL FOR DEATH, SERIOUS INJURY, AND PROPERTY LOSS. The risks may include, but are not limited to, those caused by facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, instructors, and/or producers of an event.

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE Kellie Jerman AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST Kellie Jerman FOR PERSONAL INJURY OR PROPERTY DAMAGE.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Kellie Jerman, its agents, heirs and employees.

In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.

I also agree that Kellie Jerman has permission to use my likeness in pictures and video, for marketing purposes on social media platforms, personal website, flyers, signage and email campaigns. I understand I have the right to opt out if I do not agree to the use of my likeness, and agree to do so directly to Kellie Jerman both verbally and in written format.

This Agreement was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. The Participant, Authorized Guardian and Kellie Jerman agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in
accordance with the purposes for which it is entered into.

In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the
parties. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.



The undersigned participant or authorized guardian of participant, affirm that they are of the age of 18 years or older or have been granted permission to participate by their authorized guardian (if under the age of 18), and am freely signing this agreement. I certify that I have read this agreement, that I fully understand its content and that this release cannot be modified orally. I am aware that this is a release of liability and a contract and that I am signing it of my own free will.
