PRIVACY POLICY &
WAIVER AND RELEASE FROM LIABILITY FOR DANCE INSTRUCTION


It is The Dance Connection's policy to respect your privacy regarding any information we may collect while operating our website. Accordingly, we have developed this privacy policy in order for you to understand how we collect, use, communicate, disclose and otherwise make use of personal information.
We have outlined our privacy policy below:
We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
We will collect and use personal information solely for fulfilling those purposes specified by us and for other ancillary purposes, unless we obtain the consent of the individual concerned or as required by law.
Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
We will protect personal information by using reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
We will make readily available to customers information about our policies and practices relating to the management of personal information.
We will only retain personal information for as long as necessary for the fulfillment of those purposes.
We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained. The Dance Connection may change this privacy policy from time to time at The Dance Connection's sole discretion.
In consideration of my enrollment or involvement in the dance instruction program offered by The Dance Connection, I understand and agree on behalf of myself and my next of kin, heirs and representatives, to release, hold harmless, and discharge The Dance Connection (also known as “The Holtz Organizationâ€) and their employees, officers, directors, volunteers, agents, and any lessor of the instruction’s or activity’s premises (collectively “Instructor†or “Instructorsâ€) from all claims, costs, liabilities, expenses or judgments, including attorneys’ fees and court costs for any occurrences in connection with any dance instruction or associated activity (including, but not limited to, demonstrations and performances). I assume all risks in connection with this instruction and/or activities and further release the Instructor/Instructors from liability for any and all claims, including claims of the Instructor’s negligence, resulting in any physical or psychological injury (including paralysis and death), illness, damages, or economic or emotional loss I may suffer because of my participation in this instruction/activity, including travel to, from and during the instruction/activity.
I acknowledge that I understand the nature of the dance activities I will be participating in and that I am in the proper physical condition and capable of participating in the related activities, understanding that the Instructor is not in any way responsible for making such a determination.
I understand that the Instructor/Instructors are not responsible for myself, my child/children or other children under my supervision, or my associates who are left unsupervised in the common areas and areas surrounding the dance studio, or other location for performances or home instruction, and that the Instructor will only be supervising myself or my child/children when he or she is participating in scheduled dance activities, programs, or instruction.
I understand that the Instructor is not responsible for personal property that is lost, damaged or stolen while I or my child/children or my associates is/are at or on the Instructor’s property.
I acknowledge and agree that it is my responsibility to maintain my own accident and health insurance coverage that provides adequate coverage for myself and my child/children participating in dance instruction and/or activities and that the Instructor does not provide accident or health insurance for those participating in its instruction, activities or programs.
I authorize and agree that the Instructor may take and use photographs, videos or likenesses of myself or my child/children as needed for its record-keeping, advertising and/or public relations projects and that I have no rights to the same and will not be compensated for the same.
I understand that the accepted practice and methodology of dance instruction entails “hands on†and other forms of physical contact with the Instructor and other students, and that this is necessary for a student to learn at an appropriate pace. I understand that if there is currently, or ever would be, any reason why I should not be touched, or should only be touched in a specific way, that it is my responsibility to inform the Instructor as to what is acceptable, and to discuss any related physical or psychological issues with the Instructor.
I acknowledge and agree that I have voluntarily chosen to participate in the Training offered by The Dance Connection at my own risk. I acknowledge and am aware that dance training and related activities are potentially dangerous and may involve significant physical exertion. I am aware that this activity involves certain risks to person and property, including the potential for physical injury, both minor and major, disability, and death. By my participation in in person at the studio, home visits by the instructor, and virtual dance classes or other activities with The Dance Connection, I voluntarily, knowingly and freely accept and assume all risk, both known and unknown, even if arising from the negligence of a The Dance Connection employee, and accept full responsibility arising from my participation in this activity, including but not limited to, not exceeding my physical limitations, selecting the appropriate level class and any injury or damage (including bodily, computer or other property damage) that may be sustained while participating in this activity. This release and waiver includes, in each such case, all claims in respect of death, bodily or psychological injury, illness, loss of privacy, property damage, loss, financial obligation, or expense, and in each case, regardless of the cause or whether such claim arise from tort, contract or otherwise, and even if caused by negligence, whether passive or active.
I understand that this document is written to be as broad and inclusive as legally permitted by the State of Florida. I agree that if any portion is held invalid or unenforceable, I will continue to be bound by the remaining terms.
I have read this two-page document, and I am signing it freely. No other representations concerning the legal effect of this document have been made to me.
