Consent Release Waiver & Conditions

Waiver/release for communicable diseases including COVID-19 assumption of risk/Waiver of liability/indemnifications agreement, Consent/Release, Terms and Conditions:
Dance Education Center, LLC (DEC) and Nicole Rogoski as owner have put in place preventative measures to reduce the spread of COVID-19, however, cannot guarantee that you or your child/children will not become infected with the virus. During the COVID Global Pandemic, if there is a mandatory shut down, classes will be held via Zoom in lieu of in-person instruction to help manage safety.
I, the undersigned, hereby acknowledge the physical demands and inherent risks involved in dance/movement activity, guaranteeing the registered student(s) to be in sound physical condition and we agree to hold the Dance Education Center, LLC its members and employees, in both individual and official capacities, harmless from liability for injury or damage to person or property as a result of said student’s participation in any Dance Education Center, LLC activities. We also acknowledge the need for occasional physical contact to assist in the teaching process. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren)or myself including, but not limited to: personal injury, disability, death, illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19, damage, loss claim, liability or expense of any kind that may be experienced or incurred in connection with attendance at DEC. While particular rules and personal discipline may reduce the risk, the risk of serious illness and death does exist. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, even if arising from negligence of others and assume full responsibility for my participation.
Note: Returning or joining Dance Education Center, LLC is permissible only if the following guidelines have been met:
• I have no illness or show any virus symptoms, such as fever, cough or congestion
• None of my relatives (living with me) have been diagnosed or have COVID-19 within the last 14 days
• I agree to follow the proper hygiene and safety guidelines put into effect by DEC, from the CDC including temperature checks, frequent hand sanitization, and maintaining appropriate physical distancing, and masks in required areas
Dancers with signs of illness or those unable to conform to the DEC guidelines listed above MUST remain home .
Terms and Conditions:
1. No initial payment refund for registration cancellation.
2. Dance Education Center, LLC must receive written notice of student’s cancellation of class prior to the start of new quarter or will be billed and responsible for payment.
3. Families and dancers must uphold the school's code of conduct. Non-compliance may result in dismissal without refund.
4. All payments are due and payable as indicated in the Dance Education Center, LLC calendar. A late fee will be assessed if payment is not received when due, additional late fees assessed daily. A $25.00 returned check fee will apply.
5. All accounts will require a credit card on file. Families can submit a check or cash on/or before the due date. Any past due accounts will be assessed a late fee.
6. All credit card transactions will include at 5.5% convenience fee.
7. I hereby freely grant Dance Education Center, LLC or its affiliates/members permission to publish photographs/video taken of above student for editorials, advertising, online or commercial purposes.
This is to certify that I, as parent/guardian, with legal responsibility for the participant(s) have read and agree to assume RISKS in this Waiver/Release. I hereby consent and approve in all respects the terms and condition of this Agreement (Waiver/Release)
