LIABILITY RELEASE & TERMS/CONDITIONS
I am over 18 or am a parent/guardian/carer signing on behalf of myself and/or children.

WAIVER OF LIABILITY
I Student/Guardians/Parents recognise and understand the risks of physical injury inherent to fitness, performing arts, acrobatics and dance training and I fully assume these risks. I hereby release Midland Dance Studios, its affiliates dance studios, event sponsors, employees and dance teachers from all liability for injuries sustained or illnesses contracted while attending or participating in any dance classes, rehearsals, workshops, or performances. I agree to indemnify, defend, and hold harmless Midland Dance Studios, its affiliate dance studios, event sponsors, employees and dance teachers for liabilities, costs and judgments arising from acts of omissions committed by myself or my child which result in injury or damage to any person or property.

GENERAL TERMS/CONDITIONS
• Please advise MIDLAND DANCE STUDIOS of any changes to your enrollment throughout the year, for example addition of classes, cancellation or change of contact or medical information
• ALL choreography/competition costumes remains the intellectual property & copyright of MIDLAND DANCE STUDIOS
• Choreography CANNOT be competed under any other studio name other than MIDLAND DANCE STUDIOS
• Competitive Troupe costumes CAN NOT be sold without the permission of MIDLAND DANCE STUDIOS o Parents & Students are expected to be polite and respectful of all staff
• food is only to be consumed in the foyer, not the studios
• Please respect our premises - please put your rubbish in the bins provided, clean up any mess you/child makes, etc. Destruction of property will not be tolerated and will be at the expense of the you
• Parents must come inside to collect students under the age of 10yrs, students are not permitted in the car park without supervision
• MIDLAND DANCE STUDIOS is not responsible for any loss/damage to items brought onto the premises
• Parents & Students are encouraged to join our private Facebook Group to see current information, events, news and more. “Request to Join” for approval.

CLASS TERMS/CONDITIONS
• Eating food and chewing gum is not allowed in class
• Jewellery is not permitted
• Students in exam classes, must sit the syllabi exams when recommended by the teacher to move up in levels
• Class Levels are at the discretion of the teaching staff
• If you/your child wish to participate in external workshops, performances, competitions please notify their teacher and staff members.
• MDS Disciplinary policy - students acting inappropriately/distracting others, being discourteous or misbehaving will receive 3 verbal warnings. After which a brief one on one chat with the teacher to refocus and discuss behavior. If this is unsuccessful, parents will be called to collect the child from class where they will also receive a one class ban at parents expense plus be required to attend a meeting with teacher, parents and studio director. In the event the student continues, a full expulsion maybe issued.

THE BREACH OF CONDITIONS BELOW WILL RESULT IN DISMISSAL FROM MIDLAND DANCE STUDIOS
o Midland dance studios has a zero tolerance policy for bullying acts in person or via social media, verbal or physical
o Public discrediting of midland dance studios any staff , student or member in public forums will not be tolerated. Should you have any concerns for your child’s well being...please contact MS TABETHA VAGLIVIELLO (OWNER/DIRECTOR)

UNIFORMS
Uniforms are compulsory for all dance classes with exception on our lifestyle classes bellydance and fitness who are required to wear studio colors where possible. Students are required to wear class uniform, appropriate shoes, no jewellery, water bottle.
Hair pulled back in high bun or if short off face with head band

MEDICAL ATTENTION
In case of physical injury or medical emergency, I hereby authorise Midland Dance Studios to make necessary arrangements to transport myself or my child to a medical treatment facility as necessary. All such transportation and medical treatment will be at my sole cost and expense. In extreme emergency, or if my child is under 18 years of age, I understand that Midland Dance Studios will attempt to notify the person(s) I have named in my enrollment form as my emergency contact(s) of my condition and how to reach me.

PHOTO RELEASE
Midland Dance Studios reserves the right to use photographs and videos taken during classes, workshops, performances, or other affiliated events for the purposes of instruction, advertising and promoting Midland Dance Studios and its programs. We cannot guarantee children will not be in promotional footage or photos but we will not name the child/children without parental knowledge or consent.

CLASS WITHDRAWAL
To withdrawal from classes, email info@midlanddancestudios.com.au with your full name, DOB and classes your enrolled into - two weeks before the commencement of new term. If you do not then you will be charged for the upcoming term once payment is received your account will be terminated thereafter.

RECITALS ARE COMPULSORY
On enrollment to Midland Dance Studios you agree that if your child commences/continue classes in term 2 or term 4 you understand Mid year recital and end of year recital are compulsory. A $50per student non refundable charge will be added to your account for non attendance to meet the cost of venue hire.

COSTUMING
Mid year recital T-shirt payment needs to be paid by the 1st June $25
End of year recital costumes need to paid in full by the 1st of September this will vary from year to year

COMMUNICATION POLICY
• EMAIL, PHONE, RECEPTION, DANCE STUDIO PRO OR STUDIO FB are all acceptable forms of contact. o Phone, email, contact during office hours 9am-3pm on weekdays, we cannot ensure we are able to answer the phone once classes commence, but your call will be returned as soon as someone available
• Phone calls studio phone, directors/owner mobile will not be answered between 9.30pm-9.00am on weekdays or 6.00pm-9.00am weekends, these are not business hours so please refrain from calling during these hours
• There is to be NO communication regarding studio questions/issues via personal call, social media to any staff members private accounts, staff are under instruction not to respond & refer you to contact the office, please respect their privacy.

ONLINE CLASSES/VIDEO WAIVER
"As with all exercise and dance programs, when using our exercise and dance videos/online classes, you need to use common sense. To reduce and avoid injury, you will want to check with your doctor before beginning any exercise or dance program. By performing any fitness or dance exercises, you are performing them at your own risk. (midland dance studios) nor its instructors will be held responsible or liable for any injury or harm you sustain as a result of our dance program or online videos or any information shared on our website, emails, or social media. This includes Facebook, Instagram, and text messages.

• Student if under 18 must have permission to be online from a parent/guardian
• Suitable clothing - UNIFORM MUST BE WORN
• Webcams must be in a communal space like a living room - rather than a bedroom or whatever space they're in must have a door open
• by participating they are doing so at their own risk;
• they must ensure and confirm they have suitable, non-slip floor space in which to participate;
• the activities should be avoided if they have, or suspect they may have any current health concerns, injuries, aches and pains.
• Younger children 10 under must have an adult present
• All session are videoed this is non optional

CONTRACT OF FEES
PAYMENT METHOD
• VIA DSP Portal - with Mastercard/Visa/Paypal (DSP Dance Studio Pro – Studio Account Management Software) VIA MDS Reception - Mastercard/Visa/Cash
• Fees are posted to student/parents DSP accounts by week 8 of the term
• Fees must be paid at the start of each term by the first day of class commencement

LATE FEES
MDS reserves the right to impose a late payment fee/s at the rate of 10% per week accumulative. Should the debt be referred to a debt collector their costs will be added onto the out-standing debt.

REFUNDS
• There are no refunds
• Refunds will not be issued for classes missed or in the event that you find you cannot continue.
• Fees paid are not exchangeable for other services or goods.

COVID POLICY
I understand that in the case of a lockdown and/or COVID-19 restrictions which effect the studio, term fees which have been paid are NON-REFUNDABLE, classes will be available online all effort will be made to ensure the smooth running of classes at home. In case of equipment/software errors problems classes can be made up - but these must be booked with miss Tab.

Midland Dance Studios will need to operate in line with government policy/regulations in regards to immunisation, immunisation passports at our venue or external venues. This includes but not limited to all competitions, performances, concerts and all other events/occasions/classes. Every effort will be made to ensure all students are included where practical and possible, but MDS accepts no responsibility for exclusions or inability for a non immunised student to participate in any of the above.

Fee installment packages terms and conditions
• first installment is due prior to commencement of classes
• fee installment packages are weekly or fortnightly
• Set dates are provided upon meeting with tabetha and must be strictly adhered to
• missed/late payments: incur a 10% charge on amounts unpaid for that installment period o late charges will continue for every payment not received by set dates o contact us if you are aware you will miss a payment,
• Alternate arrangements/agreements can be made with the director for some circumstances
• installment packages are not ‘pay as you go’
• the cancellation period from commencement of class still applies
• there is no early withdrawal from ezipay, installments must continue until the account is cleared in full or the balance of term fees is paid at the time of cancellation class fees are on a term basis, not per lesson attended
• as contract of fees above

ACKNOWLEDGMENT WAIVER
In signing this Release, I acknowledge and represent that I have fully informed myself of the content of the waiver, all terms & conditions the FAQ document in the MDS parent portal and all policy’s, procedures fees and charges contained within. Further I hold MDS harmless in agreement by reading it all before I sign this waiver, and I understand that I sign this document in my own free will; no oral representations, statements, or inducements, apart from the written statement, have been made. I further state that I am at least eighteen (18) years of age and am fully competent to sign this agreement; and that I execute this release for full, adequate, and complete consideration fully intending to be bound by the same. I further state that there are no health-related reasons or problems which preclude or restrict my or my child’s participation in this activity, and that I will pay any medical costs that may be attendant as a result of injury to me or my child.
