Virtual Privacy Agreement
I agree that I will not record (Audio or Video) any part of virtual classes in which I am participating through The School of Nimbus. This includes Zoom live interactive classes, pre-recorded classes and live events/webinars.
Enrollment Changes/Cancellations
I agree that any cancellation or enrollment changes from a class, camp or intensive must be communicated to The School of Nimbus in writing through email at least 2-weeks prior to the registered start date or 2-weeks after the families registration date if enrolled after start of term. Not informing The School of Nimbus of changes or cancellations in enrollment after two weeks from students' start date will require full payment of the class, camp or intensive.
If the family wishes to change enrollment due to virtual classes they will have 2-weeks from the date that The School of Nimbus announces the change to inquire about cancellation. All classes that a student has attended will not be refunded. Only non-attended classes will be refunded at a refund rate of $20/class.
I understand that classes with enrollment lower than four (4) students at the close of registration may be cancelled at The School of Nimbus' discretion.
I understand that placement in all classes is at the discretion of the School of Nimbus Director and Teaching Artists. Students are evaluated throughout the semester for accurate placement in order to ensure student success. The School of Nimbus will give advanced notice to all students/families of any and all schedule changes.
COVID-19 / Zoom Classes
If classes at the School of Nimbus move to a virtual platform due to Health Regulation or CDC Guidelines ALL students will automatically be transferred to online classes via Zoom. Please note, if classes are moved to a virtual platform The School of Nimbus has the right to adjust the class schedule.
Registration Fee
I agree that if I enroll in The School of Nimbus, a non-refundable registration fee of $75 (New Students) or $25 (Returning Students) is due at the time of registration to hold a spot in class.
Authorization to Seek Medical Treatment
I authorize Nimbus Dance Works, Inc. Administrators, Teachers and Staff to seek medical treatment for myself/my child by a licensed medical professional and act on my/his/he/their behalf according to their best judgment in arranging for emergency care. I further request and authorize licensed medical professionals to treat me/my minor in the case of injury.
Authorization of Use of Photos and Media
I understand that I or the student participant may be photographed or recorded from time to time in relation to activities sponsored or produced by Nimbus Dance Works, Inc. or its affiliates and partners. I authorize Nimbus Dance Works, Inc. to exclusively and perpetually use any and all media obtained during or related to such activities, and grant them exclusive rights to use and incorporate photographs, sound bites and/or video footage taken as a result of the participation in Nimbus Dance Works, Inc.’s activities, events, presentations, performances, rehearsals, etc. I understand that Nimbus Dance Works, Inc. may use the photographs, sound bites and/or video footage in their publicity and advertising and I agree that I will not lay claim or allow others to lay claim against Nimbus Dance Works, Inc. related to such use. I release Nimbus Dance Works, Inc. its Board of Directors, employees, agents and affiliates from and against any and all claims, demands, actions, causes of actions, suits, costs, expenses, liabilities, and damages whatsoever that I may have against Nimbus Dance Works, Inc. in connection with the media herein described. I also authorize Nimbus Dance Works, Inc. to use images/footage of me or the student participant in activities related to interviews with the press, social media outlets, radio and television interviews, etc.
Coronavirus/COVID-19 Waiver
I understand that I am participating/attending this event/program on my own free will. I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that Nimbus Dance Works, Inc. has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that Nimbus Dance Works, Inc. can not guarantee that I will not become infected with the Coronavirus/Covid-19.
I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others. I acknowledge that I must comply with all set procedures to reduce the spread while at any Nimbus Dance Works, Inc. events and/or programs. (ie. wearing masks, social distance, temperature checks)
I hereby release and agree to hold Nimbus Dance Works, Inc. harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of Nimbus Dance Works, Inc., or that may otherwise arise in any way in connection with any services received from Nimbus Dance Works, Inc.
By signing this waiver, I release Nimbus Dance Works, Inc. and its employees, affiliates and contractors from all claims derived from any injury/sickness that may be sustained by me or my party while attending any rehearsal, event, or outside performance. This Waiver is intended to be as broad and inclusive as is permitted by the laws of the State of New Jersey.
