DEI VIRTUAL STUDIO & ONLINE LEARNING Terms & Conditions & Waiver
DEI reserves the right to deliver class content via an online system in the event that classes are not able to be conducted live for any reason including but not limited to: weather, teacher absence, or governmental advisory. This is an in-home practice resource or a live online class! This is an addition to your studio training that you can do at home at any time. These resources do not replace your studio training, but will be a great alternative while our studio may be temporarily closed. This is intended to enhance your dance education experience and be a quick go-to, if you can't get to the studio. Remember, not all schools or teachers use the same teaching methods and terminology. So, always check with your teachers if you have questions.
It is very important to warm-up properly and to dress in dance wear, just like you do at the studio. Check your surroundings to ensure an open area for practice. Never force, strain or push too hard in any exercise or lesson. Be sure you have enough room to perform your movements safely. For tap lessons, ask your parents to get you a piece of plywood (or other temporary surface) so that you will not damage the floors in your home! Remember, dancing is a strenuous physical activity and since there is no direct supervision, you are urged and advised to seek the advice of a physician before fully participating in this activity. All suggestions and comments relating to the moves and choreography are not required to be performed by you and are carried out at your election while viewing the Virtual Studio videos. You understand that you are responsible to judge your physical and mental capabilities for these activities. You need to determine if your ability matches and can handle the requested dance moves and choreography. You expressly waive and release any claim that you may have at any time for injury of any kind against DEI or any person, entity, site or provider involved with the virtual studio including the on-line instructors or organizations.
The resources provided are not meant to replace or provide in-class lessons & guidance. Contributors, both your DEI and other third party providers make no guarantees or assurances as to the successes one may or may not have by using these resources. Each person’s results will be individual and will be based on a unique set of circumstances including effort, consistency, and more.
You agree not to use the virtual videos/classes to re-post or otherwise transmit information, data, text, software, music, sound, video, messages or other material (“Content”) contained in the videos to other members or non-members. The video is for use by the individual members of DEI and the access code or link is not to be shared with any other individual.
You agree that DEI may at any time and for any reason terminate your access to the Virtual Video site(s) or restrict or suspend your access to all or any part of the service at any time, with or without notice and without any liability.
All materials on the Websites/links/video including without limitation names, logos, trademarks, images, text, videos, illustrations and other elements are protected by copyrights, trademarks and/or other intellectual property rights owned by DEI or any other provider of these videos and classes.
YOU AGREE THAT YOUR USE OF THE WEBSITE SHALL BE AT YOUR RISK. THE WEBSITE/LINKS AND THE MATERIAL ARE PROVIDED “AS-IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. DEI IS NOT LIABILITY AND HAS NO WARRANTY ABOUT THE ACCURACY OR COMPLETENESS OF THIS WEBSITES/LINKS CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS WEBSITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES OR INACCURACIES OF CONTENT, PERSONAL INJURY OR PROPERTY DAMAGE; ANY INTERRUPTION OR CESSATION OF TRANSMISSION; ANY BUGS, VIRUSES, TROJAN HORSES OR THE LIKE WHICH MAY BE TRANSMITTED TO AND THROUGH THE WEBSITE.
You agree to defend, indemnify, and hold harmless DEI, its subcontractors, officers, employees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt an expenses arising from (i) your use of and access to the website, (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation any copyright, property or privacy right or (iv) any claim that one of your submissions of contract caused by a third party.
MEDIA RELEASE I understand that the activities with DEI, I or my child participant, may be photographed or videotaped. I agree to allow any photo, video or film likeness to be used for any legitimate business purpose to DEI.
This Agreement shall remain in full force and effect for so long as it is posted on any of the websites and until DEI revokes this Agreement/Waiver.
This Agreement shall be governed by the laws of the State of Wyoming and jurisdiction is Natrona County, Wyoming.
