A PARENT, LEGAL GUARDIAN OR EMPOWERED REPRESENTATIVE OF EACH MINOR CHILD(REN) REGISTERING participant in Ashanti Cultural Arts Programs MUST AGREE TO THE TERMS OF THIS WAIVER AND RELEASE OF LIABILITY AND NAME AND LIKENESS PRIOR TO THE CHILD(REN)PARTICIPATING in Ashanti programs in publications, news releases, online, and in other communications related to the mission of Ashanti Cultural Arts
___Physical Condition: On behalf of my child(ren), I accept and assume any and all risks associated with his/her/their attendance and participation in Ashanti Cultural Arts, Summer Camp or any program operated by Ashanti Cultural Arts, Enrichment,Inc. (here in after “Ashanti Camp and/or programs “) and all related activities I understand that my child(ren) should not attend “Ashanti Camp and/or programs “ if he/she/they are not in a healthy condition. Furthermore, I do hereby verify that my child(ren), to the best of my knowledge, is free from contagious disease, is fully immunized, and is able to participate in “Ashanti Camp and/or programs “. Therefore, I hereby confirm that my child(ren): (i) has no psychiatric, medical, and/or physical condition or history which would prevent him/her from participating in Ashanti Camp and/or programs and/or endanger himself/herself/themselves or others at Ashanti Camp and/or programs (ii) has not been instructed by any physician to refrain from participating in Ashanti Camp and/or programs and (iii) is physically fit and able to participate in Ashanti Camp and/or programs.
____Equipment and Facilities : I understand and agree that my child(ren) must abide by Ashanti Camp and/or programs policies and rules and the instructions of the Ashanti Camp and/or programs staff at all times, and that my child(ren)’s failure to do so will result in his/her/their immediate dismissal from Ashanti Camp and/or programs. Some of these policies and instructions are written and some are at the sole discretion of the Camp directors and staff; however it is understood that all policies, rules and instructions seek at all times to ensure the overall safety of the Camp and each of its participants. Furthermore, should my child(ren) fail to behave in an appropriate manner, intentionally harm another participant, exhibit signs of illness, or otherwise violate the Ashanti Camp and/or programs policies and rules, I shall promptly retrieve my child when contacted by Ashanti Camp and/or programs to do so, or, if I am unable to do so, notify Ashanti Camp and/or programs of the person retrieving my child(ren) on my behalf. I acknowledge and agree that no part of the tuition paid will be refunded to me should my child(ren) be dismissed from the Ashanti Camp and/or programs. I also understand and agree that no reduction or prorate in the tuition will be made for late arrival, early departure, vacations, illness, or injury.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing, wearing a face mask and have, in many locations, prohibited the congregation of groups of people. Ashanti has put in place preventative measures to reduce the spread of COVID-19; however, Ashanti cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Ashanti could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I agree that I will not participate in or send my child to any Ashanti on-site programming, including studio classes, summer creative arts camps, workshops, etc. if I/my child show any of the following symptoms of Covid-19. By signing this agreement, I agree that I will not send my child to any AShanti on-site programming if they show any of the following symptoms of Covid-19. Symptoms may include, but not limited to: ● Fever of 99.5 in the last 72 hours ● Persistent cough ● Difficulty breathing ● Chills ● Muscle pain ● Sore throat ● Loss of taste or smell
___Assumption of Risk: In the event that any damage to equipment or facilities occurs as a result of my or my family’s willful actions, neglect or recklessness I acknowledge and agree to be held liable for any and all cost associated with any actions of neglect or recklessness I understand that my child(ren) and each participant in the Ashanti Camp and/or programs, will be engaging in activities that may involve the risk of serious physical injury, illness, permanent disability, dismemberment and death, and that also involve the risk of severe economic and property l.oss and damage. I understand that these risks may result from the actions, negligence and failure to act of my child(ren) and others (including but not limited to other participants in, and the organizers, employees, staff, counselors, and volunteers, if any) and the conditions of any real or personal property, facilities or equipment used during the Ashanti Camp and/or programs. I also understand that there may be risks involved which are not known to me, my child, Ashanti Camp, or each of its organizers, employees, staff, counselors and volunteers, if any, and may not be foreseen or reasonably foreseeable by any of the foregoing entities or persons at this time or at the time of the Ashanti Camp and/or programs and any activities in which my child(ren) may participate. I, on behalf of my child(ren), assume all of the foregoing risks including the risk of any negligence by other participants or by Headfirst and its owners, partners, directors, officers, employees or agents, and the risk of injury caused by the condition of any real or personal property, facilities or equipment used during the Ashanti Camp and/or programs, and accept personal responsibility for any injury (including, but not limited to, personal injury, disability, dismemberment and death), illness, damage, loss, claim, liability or expense (including reasonable attorneys’ and professionals’ fees), of any kind or nature, that my child(ren) or I may suffer arising out of or in connection with the Camp or my child’s participation in or attendance at the Camp. By signing this release form, I/we (parent/guardian) assume all risks related to the use of any and all spaces used by Ashanti Cultural Arts, Inc. and Sponsors. Pictures may be taken during classes, events for grant, publicity use. Furthermore, I/we agree to obey the class and facility rules and take full responsibility for my/our behavior in addition to any damage I/we may cause to the facilities utilized by Ashanti Cultural Arts, Inc.
