Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, provincial, and local governments and federal and provincial health agencies recommend social distancing.Imagine Studios has put in place preventative measures to reduce the spread of COVID-19; however, Imagine Studios, faculty, subcontractors cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending Imagine Studios could increase your risk and your child(ren)’s risk of contracting COVID-19.By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Imagine Studios events, activities and classes and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Imagine Studios may result from the actions, omissions, or negligence of myself and others, including, but not limited to,Imagine Studios employees, sub-contractors, volunteers, and program participants and their families.I/we hereby acknowledge and agree that I/we will comply with the implementation of the Protocols and that any failure on my/our part (or on the part of my/our child) to comply with the Protocols and their implementations may have consequences (including without limitation a withdrawal of permission for me or my/our child to participate in any Activity or Activities) I/we understand that the implementation of the Protocols may involve the collection, use and disclosure of personal information about me or my/child and I consent to same;that I/we have carefully read this ACKNOWLEDGEMENT, RELEASE, INDEMNITY, AND ASSUMPTION OF RISK that I/we fully understand same, and that I am/we are freely and voluntarily executing the same; that I/we have been given the opportunity and that I am/we are encouraged to seek independent legal advice prior to signing this document.I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Imagine Studios or participation in programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Imagine Studios its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Imagine Studios, its employees, sub contractors, agents, and representatives,whether a COVID-19 infection occurs before, during, or after participation in any Imagine Studios program in the Parkway Place Mall building and/or off property.
BY REGISTERING AND PAYING FOR ANY CLASS, EVENT, OR OTHER ACTIVITY THROUGH IMAGINE STUDIOS WEBSITE, EMAIL, MAIL OR IN PERSON YOU ARE AGREEING TO ALL OF THE ABOVE CONDITIONS AND WAIVERS. IF YOU ARE AN ATTENDEE OF OUR REGULAR CLASSES AND HAVE REGISTERED AND ENROLLED IN A CLASS THROUGH THE “PARENT PORTAL”YOU AGREED THROUGH THERE AS WELL. PLEASE DO NOT HAVE YOUR CHILD/YOURSELF PARTICIPATE IN ANY CLASS OR EVENT UNLESS YOU ACCEPT AND AGREE TO ALL OF THE TERMS IN THIS AGREEMENT.
