I HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge Danceworks, Inc. and its agents, employees, officers, directors, affiliates, successors and assigns, coaches, teachers and trustees of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my or my child’s participation in any of the events or activities conducted by, on the premises of, or for the benefit of, Danceworks, Inc. provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.
I understand that the activities, in which I or my child will participate, are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalf of myself, my heirs, assigns, administrators, executors and next of kin, I waive all claims for damages, injuries and death sustained to me or my property, that I may have against the aforementioned released party to such activity, including claims in tort, contract, equity or otherwise.
I acknowledge, agree, and represent that I understand the nature of dance, aerobic and gymnastic activities and that I/my child is qualified, in good health, and in proper physical condition to participate in such activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.
By this Waiver, I assume any risk, and take full responsibility and waive any claims of personal injury; death or damage to personal property associated with my child or me attending class at Danceworks, Inc., dancing and/or performing aerobic or gymnastic activity including but not limited to using the facility and its equipment in any manner, form or fashion, and practicing and/or engaging in any aerobic activity or action sports activities, events or other related activities on and off the premises.
This WAIVER AND RELEASE contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.
The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of Danceworks, Inc., whether by agreement, by operation of law, or otherwise.
I have read, understand and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by signing this WAIVER AND RELEASE I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability on behalf of myself and my child to the full extent of the law. I am 18 years of age or older and mentally competent to enter into this waiver.
I understand and agree that in consideration of enrollment at Danceworks, Inc., I, as a parent/guardian, consent to such contact which is reasonable and appropriate to dance/gymnastic instruction. I, as a parent/guardian, understand that dance /gymnastics is a highly physical activity which may result in physical injury. Such injuries include but are not limited to fractures, strains, sprains and tears to various parts of the body. I further agree to assume all risks inherent in the instruction of dance/gymnastics. Furthermore, any pre-existing conditions must be disclosed by the parent/guardian at the time of registration. I understand that pictures taken of my child during school functions may be used on school bulletin boards, in the school album, advertisements and in the recital program or video. My child’s name may appear in the recital program and on the annual recital t-shirt. I hereby authorize Danceworks to obtain emergency medical assistance for my child in my absence. I have read and agree to the above paragraph and the general information below. I certify that I am the parent/legal guardian of the student(s) on this account, and I hereby acknowledge, consent, and agree to my student(s) participating in Danceworks classes and performances.
General Studio Information
Dress Code:
There are no color or style requirements for dance wear. However, students should come prepared to stretch and move and therefore a leotard and tights are required for all classes including hip hop. Crop tops and exposed midriffs are not allowed in dance class. Dance pants will not be permitted in ballet class. Jeans, sweaters, turtlenecks, and other street wear are inappropriate for dance class. Hair should be put up in a bun, braid, or ponytail at home before class. If the class includes tumbling (this includes all preschool classes), be sure hair accessories will not interfere with rolls or headstands. Students should have appropriate footwear (purchased at the studio) for the class in which they are enrolled. Students will not be permitted to take class in bare feet or socks. Please label all dance shoes with first and last name. Proper attire for dance class promotes a serious learning environment and helps everyone to focus. Please adhere to our dress code.
Food & Beverages:
Eating and drinking at the studio should not be necessary for most students. However, a student taking more than one hour of class may bring a water bottle. Food is not permitted in the dancing room. Water bottles must be labeled with student’s name and may contain water only. Chewing gum while in dance class is dangerous. Gum is not permitted during class! For the safety of several of our students, please keep our studio peanut free.
Class Observations:
For your convenience, video monitors are available in the waiting area for weekly viewing.
Attendance:
Regular attendance is essential in order for each student and the class as a whole to make progress. Students should strive to make every class meeting and be on time. Late entry is disruptive for the student and the class. If a student must miss a class, he or she may make it up by taking a similar class when and if a comparable class is available, at the discretion of the studio. Tuition will not be refunded for missed classes.
Drop Off and Pick Up:
Parents are expected to supervise their children while on the premises; the office staff cannot be responsible for supervising students before and after class. Parents should walk their child to the office, assist them with shoes if needed, and wait with them until class begins. Parents must be on time at the end of class and come to the office to pick up their child so we can be sure everyone is supervised. No child, no matter how old, should be instructed to wait on the sidewalk or in the parking lot.
Communication:
In the case of a closing due to inclement weather, there will be a message on the studio voicemail. In questionable weather, students or their parents are responsible for calling the office to find out whether classes are canceled. Please provide a current email that you check frequently for studio correspondence. Email is our primary form of communication. You will miss important notifications (newsletters, closings, recital info etc.) if we can’t reach you via email.
Tuition:
Tuition may be paid in full in September or may be broken into nine equal payments throughout the year. If you choose to pay in installments, payment is due at the first class meeting of every month from September through May. A late fee will apply after the 15th of the month. Any family attending over two hours per week of dance class will be charged a discounted rate for all time exceeding two hours. Danceworks' policy is that tuition is non-refundable. Your tuition holds your spot in the class. If you miss a class, your spot cannot be made available to another student ~ we are still holding the spot for your student. Extended vacations do not excuse your tuition obligation. If you wish to withdraw and re-enroll mid-year for an extended absence, a new registration fee will apply and your class placement will depend on availability. Danceworks depends on classes being filled in order to keep the studio running, and cannot be responsible for a student's lack of attendance. However, in extenuating circumstances such as serious illness or injury of the student, any unused tuition may be refunded. If a student chooses to withdraw permanently from a class, tuition paid beyond the end of the month of notification will be refunded. Tuition is due until notification is made in writing or via email that the student will not return. Partial months will not be refunded. All tuition and any other outstanding charges for the year must be paid in full by May 15th.
Recital:
The recital is held at a local high school generally the weekend after Memorial Day. There is a mandatory dress rehearsal on Saturday, and the show is on Sunday. Participation in the recital is encouraged, but not mandatory. Seats are assigned by number and tickets are non-refundable. Recital costumes currently cost between $55 and $85. Combination classes (e.g., "tap/ballet") use the same costume for both numbers. Students are billed an optional payment of $15 per costume in October through December. All families must pay at least one fifteen-dollar deposit per costume needed for the recital before December 1st. These deposits are non-refundable. The balance will be billed in January. Payment in full is required by January 15th. A professional DVD of the recital will be available for purchase. Video recording and picture taking are not allowed at the recital. Anyone wishing to take pictures or videos is invited to do so at the Saturday dress rehearsal.
Valuables:
Please avoid leaving valuables such as cell phones, tablets and designer purses unattended in the waiting area or office. These items should be stored inside dance bags and taken into class. Cell phones must be turned off in the dance room. Danceworks is not responsible for lost or stolen articles. Please do not bring valuables to the studio.
YOU UNDERSTAND THAT BY CHECKING THE BOX YOU ARE GIVING UP THE RIGHT TO SUE DANCEWORKS, INC. FOR ANY DANCE RELATED INJURY OR THE CONSEQUENCES THEREOF.
