Release & Waiver of Liability and Covenant Not to Sue
1. In consideration of my acceptance into participation in a program of strength, flexibility, and dance training (“the Programâ€) conducted by
The J Family Dance Center LLC and John & Michael Watson, including its agents, employees, and/or authorized representatives acting on behalf of The J Family Dance Center LLC (“JFDCâ€) and for the other good and valuable consideration, and having knowledge of the dangers and risks in this program as further described below, I hereby release, hold harmless and discharge forever John & Michael Watson and The J Family Dance Center LLC and any and all employees, guest artists, dance teachers, master/workshop teachers, & tumbling coaches from any and all present and future claims, liability and demands of property damage personal injury, illness, wrongful death or other damage or cost expenses arising as a result of, or in connection with, my participation in the program or are incurred as a result of the action or inaction of any third party, including but not limited to minor children whom I may invite to The J Family Dance Center LLC (“inviteesâ€). I agree not to sue John & Michael Watson and/or The J Family Dance Center LLC in connection with such injury or damage as stated above. Initial:
2. Further, I am aware that strength, flexibility, and dance training, including equipment use, are potentially hazardous activities. I am aware and understand that fitness/dance activities involve certain risks, including but not limited to death, serious neck and spinal injuries resulting in complete or partial paralysis, heart attack, serious disability, and serious injuries to all bones, joints, and muscles and that I am voluntarily participating in these activities and using equipment and machines with full knowledge, understanding, and appreciation of the dangers involved. I agree to use any and all equipment located on the premises with reasonable care. I agree to accept any and all inherent risks of injury or death resulting from my participation in the Program. I hereby voluntarily waive any and all claims against John & Michael Watson and/or The J Family Dance Center LLC, present and future, that may be made by me and/or invitees, resulting from the operation of any and all defective equipment. I do hereby further declare myself or my child/children to be physically fit and suffering from no condition, impairment, disease, infirmity, or other illnesses that would prevent my participation or use of equipment or machines. I acknowledge that I have either had a physical examination and have been given permission to participate, or I have decided to participate in the exercise and dance training activities, programs, and use of equipment/machines without the approval of my physician in said activities programs use of equipment. 4. I hereby voluntarily waive any and all claims against John & Michael Watson and/or The J Family Dance Center LLC, present and future, that may be made by me and/or my invitees, my children/child and/or my family, and/or estate, heirs, assigns and/or others acting on my behalf and assume all risks arising inherent to participation in the Program. I hereby release, hold harmless and discharge forever John & Michael Watson and The J Family Dance Center LLC from any and all present and future claims, liability, and demands of property damage, personal injury, illness, wrongful death, or other damage or cost expenses arising as a result of, or in connection with the presence of any and all invitees, my child/children, whom I bring to The J Family Dance Center LLC and agree not to sue John & Michael Watson and/or The J Family Dance Center LLC on behalf of any and all invitees in connection with such injury and/or damage as stated above. I further agree to indemnify and hold harmless John & Michael Watson and The J Family Dance Center LLC and others listed for any and all claims based on my acts or omissions or acts or omissions of others (including invitees and participating children), arising as a result of my participation in or receiving instruction in strength, flexibility, and cardiovascular activities or any activities incidental thereto, wherever, whenever, or however the same may occur. I understand that this waiver is intended to be as broad and inclusive as permitted by Rhode Island Law which shall be the applicable law in any legal proceeding arising from a claim under the program, and I agree that if any portion is held invalid, the remainder of the waiver will continue full legal force and effect. 7. I affirm that I am of legal age and am freely signing this agreement relying on my own judgment and knowledge. I have carefully read this document and understand/acknowledge that by signing this document. I am giving up all legal rights and remedies which may be available to me for the acts or omissions of John & Michael Watson and The J Family Dance Center LLC, its employees, guest artists, dance teachers, master/workshop teachers, and tumbling coaches and others listed above.
