Participation Agreement

Risks
I understand that there are risks of physical injury associated with, arising out of, and
inherent to dancing. These risks include the potential for slips and falls, sprains, strains,
dislocations, soft tissue injuries, musculoskeletal injuries, podiatric conditions and other risks not
specified here.
Understanding these risks and the potential for others not listed, I agree to personally
accept and assume all of the risks present in my participation at Emily Rose Dance Creations,
LLC. (“ERDâ€). My participation at ERD is entirely voluntary, and I choose to participate in spite
of the risks, including by way of example and not limitation, any risk that may arise from
negligence or carelessness on the part of the persons or entities being released, from dangerous
or defective equipment or property owned, maintained, or controlled by them.
Dance education sometimes requires hands-on instruction as well as verbal instruction.
Instructors may correct dancers by touching their arms, legs, feet, hips, and back and head to
move them in the correct position. I acknowledge that this is a common standard in dance
instruction and understand that it is my responsibility to communicate clearly with my teacher
and/or the director if any form of touch is unacceptable to me.
Release
By signing this document, I release ERD and their directors, owners, students, teachers,
staff, employees, volunteers, agents, attorneys, and associates from any liability or claim that I or
my representatives may have against ERD with respect to any bodily injury, personal injury,
illness, death, or property loss or damage that may result from my participation at ERD.
I voluntarily release and forever discharge and hold harmless ERD from any and all
claims or demands for damages, loss of service, costs and expenses, injuries, attorney fees, and
any other call for reparation from any and all injury to me or my property arising in any way
from participating in dance classes, camps, intensive workshops, performances, troupes, the use
of ERD equipment or facilities, and any activities associated with ERD.
Medical Treatment and Insurance
I understand that ERD does not assume any responsibility for or obligation to provide
financial or other assistance in the event of injury or illness, including but not limited to medical,
health, disability insurance or support.
I authorize ERD to obtain necessary medical or dental treatment, including first aid,
ambulance transport, hospitalization, or such other care necessary for my health and welfare in
an emergency. If my insurance does not cover emergency treatment that is deemed necessary and
sought for me by ERD, I agree to be responsible for and pay all costs incurred on my behalf.
I release and discharge ERD from any claim which may arise on account of any first aid,
treatment, or service rendered in connection with my participation in ERD activities, or with the
decision by any representative or agent of ERD to consent to medical or dental treatment on my
behalf in an emergency.
I understand that ERD does not carry or maintain health, medical, dental, or disability
insurance coverage for any participant. I agree to take responsibility for full payment of any
emergency medical or dental costs related to my ERD participation regardless of whether I have
insurance coverage.
Photographic/Social Media Release
I understand that ERD may take photo and video recordings of me during my
participation in ERD classes and activities. I convey to ERD full rights and interest in these
recordings. I understand such recordings may be used in advertising or other published materials,
physical or virtual.
I give my consent to ERD to use any media or medium of me, my child and or family for
posting on the ERD social media pages as well as for advertising or promotional activities.
If I do NOT consent to being photographed or video recorded, I will make sure the
director is aware of my concerns and the reasons for them, I will be proactive about avoiding
being photographed or recorded, and I will hold ERD harmless if a photo or video recording of
me is released despite all precautions. I understand that this choice may limit my participation in
performances that are routinely photographed and/or videotaped.
Miscellaneous
While participating at ERD, I agree to abide by any rules, codes, and policies that are put
in place by ERD before or at any time during my participation. If I have questions or concerns
regarding any policies or decisions made by any representatives of ERD, I agree to bring them
promptly and specifically to the director’s attention.
If I file a lawsuit against ERD, I agree to do so solely in the Commonwealth of
Pennsylvania and agree that the substantive law of Pennsylvania shall apply in that action,
without regard to the conflict of law rules of that state. I agree that if any portion of this
agreement is found to be void or unenforceable, the remaining document shall remain in full
force and effect.
COVID-19
I agree and represent that I will not enter ERD facilities or engage in any of the activities
if I: (i) have a fever, (ii) feel sick, (iii) have been exposed to anyone with either a fever or illness
or contagious disease or virus of any kind. Further, I represent that if I have contracted any
infectious disease, COVID-19, or was exposed to anyone who was so diagnosed, I will
immediately notify ERD in writing. ERD will keep any such information confidential. I
understand that any failure to honor the representation in this paragraph constitutes the grounds
for the immediate termination of my membership and participation in any activities or events by
ERD.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and
voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19
by attending ERD and that such exposure or infection may result in Personal injury, illness,
permanent disability, and death. I understand that the risk of becoming exposed to or infected by
COVID-19 at ERD may result from the actions, omissions, or negligence of myself and others,
including, but not limited to, ERD employees, volunteers, and program participants and their
families.
I understand that all registration fees are nonrefundable.

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT.
Parent/Guardian Waiver for Minors (Only if student is under 18 years old)
The undersigned, parent and natural guardian, does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of the conditions set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor, the parents, or the legal guardian.
