I choose to participate in classes, performances, workshops, and other activities at Shiamak Philadelphia in association with Rhythm and Funk School of Dance of my own free will and certify that I am in proper physical condition to take part in such activities.

If I have questions about whether an activity is suitable for me to pursue, I will consult my health care provider in making that decision. If I have any known physical vulnerabilities, conditions, or injuries, I agree to discuss them with the director before participating.

I understand that a signed waiver is needed to participate in the classes, performances, workshops, and other activities. I acknowledge that sufficient time was given to carefully read this waiver, understand the risk and claims being waiver to participate in the activity, voluntarily executing the waiver.

Release
By signing this document, I release Shiamak USA of 219 Edgewater Towne Center, Edgewater, NJ 07020, ContempraDance School and Theatre, 487 Devon Park Dr #206, Wayne, PA 19087 and Rhythm and Funk School of dance of 241 Old Eagle School Rd, Wayne PA 19087 and their directors, owners, students, teachers, staff, employees, volunteers, associates (collectively referred to in this document as “RNF”) from any liability or claim that I or my representatives may have against RNF with respect to any bodily injury, personal injury, illness, death, or property loss or damage that may result from my participation at RNF.

Being of lawful age and in consideration of being permitted to participate in classes, performances, workshops, and other activities, I release and forever discharge the Shiamak USA of 219 Edgewater Towne Center, Edgewater, NJ 07020,ContempraDance School and Theatre, 487 Devon Park Dr #206, Wayne, PA 19087 and Rhythm and Funk School of dance of 241 Old Eagle School Rd, Wayne PA 19087, and their spouses, heirs, executors, administrators, legal representative and assigns from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in death, property arising in any way from my participation in dance classes, camps, intensives, workshops, performances, troupes, the use of RNF equipment or facilities, and any activities associated with RNF, which has been or may have caused solely or partly by the negligence of Shiamak USA of 219 Edgewater Towne Center, Edgewater, NJ 07020 and Rhythm and Funk School of dance of 241 Old Eagle School Rd, Wayne PA 19087.

Risks
I understand that there are risks of physical injury associated with, arising out of, and inherent to dancing. These risks include the potential for slips and falls, sprains, strains, dislocations, soft tissue injuries, musculoskeletal injuries, podiatric conditions, and other risks not specified here.

Understanding these risks and the potential for others not listed, I agree to personally accept and assume all of the risks present in my participation at RNF. My participation at RNF is entirely voluntary, and I choose to participate in spite of the risks.
Dance education sometimes requires hands-on instruction as well as verbal instruction. Instructors may correct dancers by touching their arms, legs, feet, hips, back and head to move them in the correct position. I acknowledge that this is a common standard in dance instruction and understand that it is my responsibility to communicate clearly with my teacher and/or the founder if any form of touch is unacceptable to me.

Medical Treatment and Insurance
I understand that RNF does not assume any responsibility for or obligation to provide financial or other assistance in the event of injury or illness, including but not limited to medical, health, or disability insurance or support.

I authorize RNF to obtain necessary medical or dental treatment, including first aid, ambulance transport, hospitalization, or such other care necessary for my health and welfare in an emergency. If my insurance does not cover emergency treatment that is deemed necessary and sought for me by RNF, I agree to be responsible for and pay all costs incurred on my behalf.
I release and discharge RNF from any claim which may arise on account of any first aid, treatment, or service rendered in connection with my participation in RNF activities or with the decision by any representative or agent of RNF to consent to medical or dental treatment on my behalf in an emergency.

I understand that RNF does not carry or maintain health, medical, dental, or disability insurance coverage for any participant. I agree to take responsibility for full payment of any emergency medical or dental costs related to my RNF participation regardless of whether I have insurance coverage.

Photographic Release
I understand that RNF may take photo and video recordings of me during my participation in RNF classes and activities. I convey to RNF full rights and interest in these recordings. I understand such recordings may be used in advertising or other published materials, physical or virtual.

If I do NOT consent to being photographed or video recorded, I will make sure the director is aware of my concerns and the reasons for them, I will be proactive about avoiding being photographed or recorded, and I will hold RNF harmless if a photo or video recording of me is released despite all precautions. I understand that this choice may limit my participation in performances that are routinely photographed and/or videotaped.

Miscellaneous
While a participant at RNF, I agree to abide by any rules, codes, and policies that are put in place by RNF before or at any time during my participation. If I have questions or concerns regarding any policies or decisions made by any representative of RNF,
I agree to bring them promptly and specifically to the director’s attention.

This Waiver will be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, and I agree that the substantive law of Pennsylvania shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

I acknowledge and agree with Shiamak USA of 219 Edgewater Towne Center, Edgewater, NJ 07020 and Rhythm and Funk School of dance of 241 Old Eagle School Rd, Wayne PA 19087 have given me sufficient time to carefully read this waiver, have been encouraged to seek independent legal advice prior to signing of the waiver, I am freely and voluntarily executing this waiver and I am forever prevented from suing or otherwise claiming against Shiamak USA of 219 Edgewater Towne Center, Edgewater, NJ 07020 and Rhythm and Funk School of dance of 241 Old Eagle School Rd, Wayne PA 19087 for any property loss or personal injury that I may sustain while participating in or preparing for dance classes, camps, intensives, workshops, performances, troupes, the use of RNF equipment or facilities, and any activities associated with RNF.

Signature
All participants must sign a Signature Page at the start of each dance year certifying that they have read this document, understand it in its entirety, and agree to be bound by its terms, before participating in classes.

Policies and Code of Conduct

Health, Wellness, and Preventative Measures
We stress this every season, but it is important now more than ever. Eating healthy and getting exercise is a great way to boost our immune systems. Eat lots of fruits and vegetables, get enough sleep, and treat yourself and others with kindness.

Attitude
We as dancers are tough and are known to persevere through various circumstances. Please carry that spirit into the coming months – The better our attitude, the better the experience for everyone!

Inclusivity

Individuality: We work with students as individuals and encourage each dancer’s own creativity and uniqueness.

Gender: We welcome dancers of all genders.

Ability: We encourage dancers of all abilities, typical and atypical, to give our classes a try. We do our best to accommodate each dancer’s unique needs within the limits of our resources, studio features, staff expertise, student: teacher ratio, and other factors. If your or your child’s needs are atypical, please talk with the Founder before registering to determine whether a particular class will be appropriate, and, if necessary, what accommodations are possible.

Registration & Payment
• Class level is at the discretion of the Founder. Please contact the studio for help in determining class level.
• Invoices are sent via email after registration is complete. We accept cash, check, or credit card payments.
• Payment is due in full before the second class unless other arrangements have been made with the Founder.


Missed Classes & Refunds
• We do not offer refunds except in extreme extenuating circumstances.
• Students who miss a class can review videos (if any) put up by the instructors on the portal.

Attire
• All clothing must fit properly. Dancers are welcome to dress according to the gender they identify with.

Conduct
• Be early! A wise teacher once said: “Early is on time, on time is late, and late is unacceptable!” You should arrive with ample time to change, use the restroom, get water, warm up, and focus yourself for class before class begins.
• Respect the teacher with your mind, heart, and body. Our teachers are experts in their field and have studied and practiced for many years. Listen actively and attentively in class. Do not turn your back while someone is
demonstrating or speaking. Do not speak when the teacher is speaking or others are dancing. Show that you are engaged by standing tall and keeping your eyes on the teacher or demonstrator. Do not cross your arms across your
chest, yawn, fidget, look bored or tired, etc.
• Do not contradict the teacher. If you have a question or disagreement, please stay after class to discuss so that you may reach an understanding.
• Do not correct other dancers. Only the teacher and their officially appointed assistant(s) may correct a dancer. It is not appropriate for students to correct other students.
• Bring a positive attitude to class! Accept corrections as helpful feedback that will improve your dancing. Show your appreciation by working hard and doing your best.
• Pack a water bottle! Water helps regulate your body temperature, lubricate your joints, and so much more. Staying hydrated is a must for any physical activity.
• Check in! Please check in using your name and your class at the front desk when you arrive or before you head into the studio. This helps our studio run smoothly.
• Have fun! Dance is a wonderful way to express yourself, to work out, and to improve brain function.
• Get plenty of rest! Sleep is the time when our bodies restore and heal themselves.
• Use the bathroom before class! Some teachers give a break halfway through the class. Other teachers do not give breaks. Know what your teacher wants.
• Work hard. Work smart. Be aware of aches and pains, fatigue, thirst, and hunger. Your body is your instrument. Eat a good breakfast and pack a snack in your dance bag. Plan to eat a few snacks as well as meals in your busy dance
day.

Absences and injuries:
• No excuses! Come to class if you can, even if you can only observe. This is of course unless you have a fever or any symptoms that can make others sick.
• If you must miss a class, as a courtesy, please inform the studio before class begins.
• If you are sick with a potentially contagious illness, please do not attend class.
• If you choose to take class with a pre-existing injury, please alert the teacher prior to the start of class and take responsibility for marking and non-disruptive self-care as needed.
• If you are injured during class, alert the teacher immediately in the least disruptive way possible.
• When marking a combination, please do so with attention and energy. Never mark your arms unless they are injured.
With people:
• Always be your best self at RNF. Exercise kindness, generosity, and honor.
• Lift up the spirits of those around you. Support and cheer on your classmates.
• Speak kindly of others always – to their face and behind their back.
• Practice empathy. Give others the benefit of the doubt. You may not know the whole story.
• Show leadership for younger and less experienced dancers. Include and engage people outside your age, level, and comfort zone.
In our space:
• Only water is allowed in the dance studios. Food and beverages are also allowed in the waiting area and the dressing rooms.
• Put away all food and beverages when you are done with them.
• Always leave the studios, dressing room, and waiting area better than you found them.
• Please observe recycling/trash/compost signs and put your waste in the proper container every time.

Bullying
• All members of the RNF community have the right to feel safe and protected from bullying.
• Bullying physically or emotionally harms a person, targets a person in a negative way for any actual or perceived characteristic, and/or creates a hostile environment in the dance studio. Bullying will not be tolerated in any form – direct or indirect, physical, emotional, social, verbal, written, electronic, or otherwise.
• Bullying threatens the very heart and soul of RNF. Even one documented bullying event will have repercussions under our zero-tolerance policy. Immediate termination of enrollment may be imposed for egregious violations.
• We recognize that bullying does not just occur between students. Anyone witnessed bullying or harassing another student, parent, or RNF staff member will be sanctioned.
• If you or your child are being bullied, please alert a teacher or the director as soon as possible. You may speak directly with someone, or you may anonymously report an incident by leaving us a note in our mailbox. Each situation of
bullying is unique and will be treated with urgency, proactivity, and sensitivity by the director and staff.
