Musical Theatre Workshops Participant Liability Waiver and Hold Harmless Agreement
Please read this form carefully and be aware that by registering for and participating in this program, or by registering your minor children/ward for participation in this program, you will be waiving your rights and/or the rights of your minor children/ward to all claims for injuries you or your minor child/ward might sustain arising out of this program and you will be required to indemnify, hold harmless and defend Mrs. Mickey Lubeck/MTW for any claims arising of the participation of (Actor’s name)___________________________________ in any activity, (here after referred to as “Programâ€) sponsored by Musical Theatre Workshops for all classes and camps held at the studio as well as at any venues that we shall be performing during the course of the year.
Risk of Injury: As a participant in the program, or as a parent or legal guardian of a participant under 18 years of age, I recognize and acknowledge that there are certain risks of personal injury involved with participation in the Program, and I agree to assume the full risk of injuries, damages or loss which I or my minor child/ward may sustain as a result of participating in any and all activities associated with this program.
Waiver of Injury Claims: I agree to waive and relinquish any and all claims I may have arising out of, connected with, or in any way associated with the activities of the program.
Release from Liability: I do hereby fully release and discharge Musical Theatre Workshops and its officers, agents and employees from any and all claims from injuries, damage or loss which I or my minor child/ward may have or which may occur on account of participation in the Program. Indemnity and Defense: I further agree to indemnify, hold harmless and defend Musical Theatre Workshops and its officers, agents and employees from any and all claims from injuries, damages and losses sustained by me or my minor child/ward and arising out of, connected with, or in any way associated with the activities of the Program. ** Covid-19 addendum
**ASSUMPTION OF THE RISK AND RELEASE OF LIABILITY RELATING TO CORONAVIRUS/ COVID-19
Musical Theatre Workshops has put in place preventative measures to reduce the spread of COVID-19; however, the program cannot guarantee that you or your child(ren) will not
become infected with COVID-19. Further, attending the program could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you or your child(ren) may be exposed to or infected by COVID-19 by attending the camp. You further understand that the risk of becoming exposed to or infected by COVID-19 at the program may result from the actions, omissions, or negligence of yourself and others, including, but not limited to, the Program’s employees, volunteers, and program participants and their families.
You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to you or your child(ren) (including, but not limited to, personal injury, disability, and/or death),illness, damage, loss, claim, liability, or expense, of any kind, that you or your child(ren) may experience or incur in connection with your child(ren)’s attendance at the program ("Claims"). On your behalf, and on behalf of your children, you hereby release, covenant not to sue, discharge, and hold harmless, Musical Theatre Workshops, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the program, its employees, agents, and representatives, whether a COVID-19 infection
occurs before, during, or after participation in any of the MTW programs.
Medical Emergencies: In the event of any emergency, I authorize Musical Theatre Workshops to secure from any licensed hospital, physician, and/or medical personnel any treatment deemed necessary for my minor child/ward’s immediate care and agree that I will be responsible for payment of any and all medical services rendered.
PHOTO and VIDEO RELEASE: You have my permission to use any theatre studio pictures or video of my child taken either during ​class time or during performances for the purposes of illustration, advertising, promotion, display, or publication, and for any other lawful purpose. I understand that I will not be paid for the use of my child’s photos. Photos may be used on Facebook or Youtube but no names will be released.
CANCELLATION POLICY:
Withdrawals: Musical Theatre Workshops is a 9-month commitment. We do, however recognize that life circumstances may make it necessary for an actor to withdrawal. Withdrawal requests should be made 30 days in advance and parents are responsible for payment of the final month, whether the child attends that month, or not. We do not prorate monthly tuition. In addition, there are no withdrawals accepted after the Spring Production. There is also no refund of the Production Fee for withdrawals made on or after February 1st.
